Her Excellency the Governor, with the advice of the Executive Council, has made the following Rules under the Road Transport (Safety and Traffic Management) Act 1999.

Explanatory note
The object of these Rules is to amend the Road Rules 2008:

(a) to exempt from the prohibition in the Rules on drivers stopping a vehicle on a freeway:
(i) truck drivers while stopped in designated truck parking areas, and
(ii) the drivers of public buses used to provide a public passenger service, while stopped in designated bus parking areas or bus zones or at bus stops, and
(iii) drivers of vehicles who are authorised to maintain facilities in designated bus parking areas, while stopped in those areas for that purpose, and
(b) to exempt from the prohibition in the Rules on pedestrians being on a road with a road access sign (being a sign usually used on a freeway):
(i) the drivers or passengers of trucks while in designated truck parking areas, and
(ii) the drivers of public buses used to provide a public passenger service, while in designated bus parking areas, and
(iii) the passengers of such buses, while in bus zones or at bus stops or approaching or leaving those bus zones or bus stops, and
(iv) persons authorised to maintain facilities in bus parking areas, while in those areas for that purpose, and
(c) to include diagrams of the permitted versions of traffic signs designating bus or truck parking areas.

These Rules are made under the Road Transport (Safety and Traffic Management) Act 1999, including sections 71 and 72A (the general rule-making power) and Schedule 1.

1      Name of Rules

These Rules are the Road Amendment (Exemptions for Stopping or
Being on Freeways) Rules 2010.

2      Commencement

These Rules commence on the day on which they are published on the
NSW legislation website.

[1]      Rule 177 Stopping on a freeway

Insert after rule 177 (1) (after the notes):

(1–1) This rule does not apply to:
(a) the driver of a truck while stopped in a truck parking area, or
(b) the driver of a public bus used to provide a public passenger service, while stopped:

(i)      in a bus parking area, or

(ii)      in a bus zone or at a bus stop to drop off or pick up passengers, or

(c) the driver of a vehicle who is authorised to maintain facilities in a bus parking area, while stopped in the bus parking area for that purpose.

Note 1. Bus parking area, public bus, public passenger service, truck and truck parking area are defined in the Dictionary. Bus zone is defined in rule 183 (2). Vehicle is defined in rule 15.

Note 2. This subrule is an additional NSW subrule. There is no corresponding subrule in rule 177 of the Australian Road Rules.

Insert after rule 229:

229–1 NSW Rule: exemption from prohibition on pedestrians being on a
road with a road access sign

Rule 229 does not apply to:

(a)

the driver or passenger of a truck while in a truck parking area, or

(b)

the driver of a public bus used to provide a public passenger service, while in a bus parking area, or

(c)

a person approaching or waiting in a bus zone or at a bus stop to be picked up as a passenger on a public bus providing a public passenger service, or a person leaving a bus zone or bus stop after being dropped off as such a passenger, or

(d) a person who is authorised to maintain facilities in a bus parking area, while in the bus parking area for that purpose.

Note 1. Bus parking area, footpath, public bus, public passenger service, truck and truck parking area are defined in the Dictionary. Bus zone is defined in rule 183 (2).

Note 2. This rule is an additional NSW road rule. There is no corresponding rule in the Australian Road Rules.
