Rivers and Water Supply Commission Act 1999

An Act to provide for the Rivers and Water Supply Commission to continue and for other purposes

Be it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:

PART 1Preliminary1Short titleThis Act may be cited as the Rivers and Water Supply Commission Act 1999 . 2CommencementThis Act commences on a day to be proclaimed. 3InterpretationIn this Act, unless the contrary intention appears – Commission means the Rivers and Water Supply Commission; water district means a water supply district, irrigation district, riverworks district or drainage district established or continued in force under Part 9 of the Water Management Act 1999 . PART 2Rivers and Water Supply Commission4Continuance of CommissionThe Commission, formerly established under the Water Act 1957 , continues. 5Saving for Commission's water rights, &c. (1) A right of the Commission to take water under the Water Act 1957  – (a) continues in force on the same terms and conditions notwithstanding the repeal of that Act; and (b) is taken to be conferred by a licence granted under the Water Management Act 1999 in respect of the relevant water resource, within the meaning of that Act. (2) A water district formerly administered by the Commission continues to be administered by the Commission subject to the Water Management Act 1999 as if the Commission were appointed as the water entity responsible for the administration of that district. 6Functions of CommissionThe Commission has the following functions: (a) to administer water districts in accordance with section 5(2) ; (b) to manage property of the Crown or the Commission and other property related to the administration of such districts; (c) to provide project management and project development services in the commercial water industry and related industries; (d) to undertake the necessary duties of a Government Business Enterprise; (e) such other functions related to the commercial water industry as the Minister directs. 7Contracts, &c., made by CommissionContracts, leases and agreements made by the Commission before the commencement of this Act remain in force on the same terms and conditions for the purposes of this Act unless subsequently altered by the Commission in the normal course of business. PART 3Miscellaneous8Regulations (1)  The Governor may make regulations for the purposes of this Act. (2)  Regulations may be made so as to apply differently according to matters, limitations or restrictions, whether as to time, circumstance or otherwise, specified in the regulations. (3)  The regulations may authorise any matter to be from time to time determined, applied or regulated by the Minister or an officer or person specified in the regulations. 9Administration of ActUntil provision is made in relation to this Act by order under section 4 of the Administrative Arrangements Act 1990  – (a) the administration of this Act is assigned to the Minister for Primary Industries, Water and Environment; and (b) the department responsible to the Minister for Primary Industries, Water and Environment in relation to the administration of this Act is the Department of Primary Industries, Water and Environment.
