CaseChat Overview and Summary
The court was required to determine whether the agreement was fair and reasonable, as stipulated by the Fair Work Act 2009. This involved examining whether the agreement met the criteria for "better off overall and fairer" as set by the Fair Work Act, and whether it was genuinely agreed upon by the parties involved. The court also had to ensure that the agreement did not contravene any existing laws or regulations.
The Federal Court of Australia, after reviewing the application and the submissions from both parties, found that the proposed agreement met the necessary criteria for approval. The court acknowledged the efforts of the parties to reach a fair and reasonable agreement and determined that the agreement was genuinely agreed upon and met the requirements of the Fair Work Act. The court was satisfied that the agreement was fair and reasonable and did not contravene any existing laws or regulations.
The court subsequently approved the RIGFORCE PTY LTD Integrated Ratings, Cooks, Caterers and Seafarers (Offshore Oil and Gas) Greenfields Agreement 2015. The approval of the agreement signified the court's endorsement of the terms and conditions outlined within, which were intended to govern the employment of workers in the specified industry. The court's decision affirmed the legitimacy of the agreement and facilitated the implementation of the new enterprise agreement between Rigforce Pty Ltd and its employees.
