GUMMOW J: In proceedings in the Family Court of Australia Morgan J ordered that the applicant receive 62 percent of the property in dispute. The Full Court of the Family Court allowed an appeal, and divided the property more favourably to the respondent.
The applicant's draft notice of appeal makes complaints about factual and discretionary aspects of the Full Court's reasoning. No question of law or miscarriage of justice is identified. There are no prospects of success in an appeal were special leave to be granted. The application must be dismissed.
Pursuant to r 41.10.5 we direct the Registrar to draw up, sign and seal an order dismissing the application for special leave. I publish the disposition signed by Justice Heydon and myself.
