1 Name of plan
This plan is Richmond River Local Environmental Plan 1992
(Amendment No 30).
2 Aims of plan
This plan aims to insert a definition of storey into Richmond River Local Environmental Plan 1992 so as to allow for the provision of basement level carparking to be taken into consideration in the definition.
3 Land to which plan applies
This plan applies to all land to which Richmond River Local
Environmental Plan 1992 applies.
4 Amendment of Richmond River Local Environmental Plan 1992
Richmond River Local Environmental Plan 1992 is amended by inserting in clause 5 (1) in alphabetical order the following definition:
STOREY means the space within a building between one floor level and the floor level next above or, if there is no floor level next above, the ceiling or roof above, but does not include:
| (a) | space used for carparking, laundries or storerooms, if the ceiling space does not protrude more than 1.2 metres as measured vertically above the natural ground level immediately below, or |
| (b) | the whole or any part of a roof used as an uncovered garden, terrace or deck. |
For the purpose of counting the number of storeys in a building, the number is to be the maximum number of storeys of the building which may be intersected by the same vertical line, not being a line which passes through any wall of the building.
