1      Name of plan

This plan is Richmond River Local Environmental Plan 1992

(Amendment No 30).

2      Aims of plan

This plan aims to insert a definition of storey into Richmond River Local Environmental Plan 1992 so as to allow for the provision of basement level carparking to be taken into consideration in the definition.

3      Land to which plan applies

This plan applies to all land to which Richmond River Local

Environmental Plan 1992 applies.

4 Amendment of Richmond River Local Environmental Plan 1992

Richmond River Local Environmental Plan 1992 is amended by inserting in clause 5 (1) in alphabetical order the following definition:

STOREY means the space within a building between one floor level and the floor level next above or, if there is no floor level next above, the ceiling or roof above, but does not include:

(a)

space used for carparking, laundries or storerooms, if the ceiling space does not protrude more than 1.2 metres as measured vertically above the natural ground level immediately below, or

(b)

the whole or any part of a roof used as an uncovered garden, terrace or deck.

For the purpose of counting the number of storeys in a building, the number is to be the maximum number of storeys of the building which may be intersected by the same vertical line, not being a line which passes through any wall of the building.
