MR A.S. BELL:   May it please the Court, I appear for the Australian Broadcasting Authority, which is the applicant for expedition on the summons, and I appear with MS M.N. ALLARS.  (instructed by Australian Government Solicitor)

MR S.B. LLOYD:   May it please the Court, I appear for the RG Capital Radio, which is the applicant on the special leave application.  (instructed by Gilbert and Tobin)

HIS HONOUR:   Yes.  I have looked at the papers in this matter, Dr Bell.  I understand the application is not opposed.

HIS HONOUR:   I see the reasons that you have set out in support of the application and they seem plausible.

In this matter I make an order for expedition of the application for special leave to appeal and direct that the matter be listed for hearing on Tuesday, 20 November and costs of this application are to be costs in the application for special leave to appeal and I certify for the attendance of counsel.
