Revocation and Excision of Crown Reservations Act 1981

An Act to revoke the Permanent Reservations of certain Lands and for Purposes connected therewith.

Preamble

WHEREAS the Lands referred to in Part I of the Schedule have been permanently reserved for the purposes and in accordance with the particulars respectively set out therein:

AND WHEREAS such parts of the lands referred to in Part I of the Schedule ("the lands to be excised") as are—

(a)delineated and shown hatched on the plans in Parts II and III of the Schedule; or

(b)delineated and designated by the letter "A" on the plan in Part IV of the Schedule being the land referred to in Item 3 of Part I of the Schedule save and except the land delineated and shown hatched on that plan—

are required for other purposes:

AND WHEREAS it is expedient to provide—

(a)that the permanent reservations of the lands to be excised should be revoked; and

(b)that the lands to be excised should become and be unalienated lands of the Crown.

BE IT THEREFORE ENACTED by the Queen's Most Excellent Majesty by and with the advice and consent of the Legislative Council and the Legislative Assembly of Victoria in this present Parliament assembled and by the authority of the same as follows (that is to say):

1.Short title and commencement

(1)This Act may be cited as the Revocation and Excision of Crown Reservations Act 1981.

(2)This Act shall come into operation on the day on which it receives the Royal Assent.

2.Definition

In this Act unless inconsistent with the context or subject-matter—

"the lands to be excised" means—

(a)the lands delineated and shown hatched on the plans in Parts II and III of the Schedule; and

(b)the land delineated and designated by the letter "A" on the plan in Part IV of the Schedule being the land referred to in Item 3 of Part I of the Schedule save and except the land delineated and shown hatched on that plan.

3.Revocation of permanent reservations

The Orders in Council specified in Part I of the Schedule insofar as they relate to the lands to be excised and any other Order in Council or proclamation insofar as it reserves or affects the lands to be excised shall be revoked.

4.Certain lands to be unalienated Crown lands

The lands to be excised shall notwithstanding anything to the contrary in any Act become and be unalienated lands of the Crown freed and discharged of all trusts, encumbrances, reservations, limitations and restrictions whatsoever and from every estate or interest therein.

5.No compensation payable by Crown

No compensation shall be payable by the Crown in respect of any act matter or thing done under or arising out of this Act.
