An Act to prohibit the Unauthorized Use or Possession of Membership Badges issued by the Returned Sailors' Soldiers' and Airmen's Imperial League of Australia, Victorian Branch.

BE IT ENACTED by the Queen's Most Excellent Majesty by and with the advice and consent of the Legislative Council and the Legislative Assembly of Victoria in this present Parliament assembled and by the authority of the same as follows (that is to say):

1Short title

This Act may be cited as the Returned Servicemen's Badges Act 1956.

2Unauthorized use or possession of badges

(1)No person shall wear a badge of the kind issued by the Returned Sailors' Soldiers' and Airmen's Imperial League of Australia, Victorian Branch, for the purpose of indicating that the wearer is a member of the said League or, without lawful excuse, have in his possession such a badge unless such badge has been issued to him under the rules of the said League.

(2)A person who—

(a)has been expelled in accordance with the rules of the said League; or

(b)is not and has not been for more than twelve months a financial member of the said League—

and who has been personally served with a notice in writing requiring him to forthwith deliver up to the said League or to an officer of the said League named in the notice any badge of the kind issued by the said League which is in his possession or control shall upon the expiration of fourteen days after service of such a notice be deemed not to have been issued with a badge under the rules of the said League.

(3)An emblem shall be deemed to be a badge of the said League for the purposes of this section notwithstanding that no clip denoting that the member is or has been a financial member of the League is attached thereto.

(4)[1]Any person who contravenes the provisions of this section shall be guilty of an offence against this Act and shall be liable to a penalty of not more than $20 or in the case of a second or subsequent conviction to a penalty of not more than $50.
