Part 1—Preliminary

1—Short title

These regulations may be cited as the Return to Work Variation Regulations 2018.

2—Commencement

These regulations come into operation on the day on which they are made.

3—Variation provisions

In these regulations, a provision under a heading referring to the variation of specified regulations varies the regulations so specified.

Part 2—Variation of Return to Work Regulations 2015

4—Variation of regulation 12—Employer's duty to provide work (section 18 of Act)

  1. Regulation 12(1)—after "limits on costs" insert:

    (excluding reasonably incurred disbursements such as counsel fees)

  2. Regulation 12(1)(b)—delete "(including" and substitute:

    (up to and including a pre‑hearing conference and

  3. Regulation 12(1)(c)—delete "on account of" and substitute:

    after a pre‑hearing conferencing up to and including

  4. Regulation 12(2)—delete "subsection (1)" and substitute:

    subregulation (1)

  5. Regulation 12(3)—after "reimburse disbursements" insert:

    (including counsel fees)

5—Variation of regulation 44—Costs (section 106(1) of Act)

  1. Regulation 44(1)—after "Part 6 of the Act" insert:

    (excluding reasonably incurred disbursements such as counsel fees)

  2. Regulation 44(4)—after "reimburse disbursements" insert:

    (including counsel fees)

Note—

As required by section 10AA(2) of the Subordinate Legislation Act 1978, the Minister has certified that, in the Minister's opinion, it is necessary or appropriate that these regulations come into operation as set out in these regulations.
