3 Retirement Villages Amendment (No. 1) No. 285, 1993 ˙ Short title 1. This regulation may be cited as the Retirement Villages Amendment Regulation (No. 1) 1993 . ˙ Amended regulation 2. The Retirement Villages Regulation 1989 is amended as set out in this regulation. ˙ Replacement of s.5 (Forms) 3. Section 5— omit, insert— ˙ ‘Prescribed forms ‘5.(1) The forms to be used for the purposes of the Act are the forms approved by the chief executive of the department. ‘(2) A person may request the chief executive to give the person a document setting out a form approved under subsection (1). ‘(3) The chief executive must comply promptly with a request under subsection (2). ’. ˙ Amendment of s.7 (Particulars to be provided) 4. Section 7 (at the end)— insert— ‘ Maximum penalty for contravention of subsection (2)— (a) in the case of an individual—4 penalty units; (b) in the case of a corporation—10 penalty units. ’. ˙ Amendment of s.8 (Ministerial reviews) 5. Section 8 (at the end)— insert—

Section 11— omit, insert— ˙ ‘Meaning of “public company” ‘11. In sections 12 and 13— “public company” has the same meaning as that given by the Corporations Law. ’. ˙ Amendment of s.12 (Records and accounts relating to the operation of the scheme) 7.(1) Section 12(1) (second sentence)— renumber as subsection (1A). (2) Section 12(3) (at the end)— insert— ‘ Maximum penalty— (a) in the case of an individual—4 penalty units; (b) in the case of a corporation—10 penalty units. ’. ˙ Amendment of s.14 (Records and accounts relating to the affairs of the village) 8.(1) Section 14(1) (at the end)— insert— ‘ Maximum penalty—4 penalty units. ’. (2) Section 14(2) (at the end)— insert—

Section 15(1)— omit ‘ Companies (Queensland) Code ’, insert ‘ Corporations Law ’. ˙ Replacement of Part 7 (Offences) 10. Part 7— omit, insert — ‘PART 7—EXEMPTIONS ˙ ‘Exempt organisations ‘16.(1) This section applies to exemptions under section 12(1)(a) of the Act. ‘(2) In relation to each organisation mentioned in Part A of Schedule 1, it is declared that an exemption is granted from the provisions of the Act, and on the conditions, mentioned in the Part in relation to the organisation. ˙ ‘Exempt retirement villages ‘17.(1) This section applies to exemptions under section 12(1)(b) of the Act. ‘(2) In relation to each retirement village mentioned in Part B of Schedule 1, it is declared that an exemption is granted from the provisions of the Act, and on the conditions, mentioned in the Part in relation to the retirement village. ’.
6 Retirement Villages Amendment (No. 1) ˙ Replacement of Schedule 1 (Forms) 11. Schedule 1— omit, insert— ‘SCHEDULE 1 No. 285, 1993 ‘EXEMPTIONS ‘PART A—ORGANISATIONS section 16 ‘1.(1) Organisation— Star Gardens Order of the Eastern Star Homes for the Aged Incorporated. (2) Provisions from which exempt— Part 4 of the Act. (3) Conditions of exemption— none. ‘PART B—RETIREMENT VILLAGES section 17 ‘1.(1) Retirement village— Golden Grove Hostel, Southport. (2) Provisions from which exempt— Parts 1 to 6 of the Act.
7 Retirement Villages Amendment (No. 1) No. 285, 1993 (3) Conditions of exemption— none. ‘2.(1) Retirement village— Riverlands Noosa, Tewantin. (2) Provisions from which exempt— Parts 1 to 6 of the Act. (3) Conditions of exemption— none. ‘3.(1) Retirement village— Cypress Gardens Serviced Apartments, Clear Island Waters. (2) Provisions from which exempt— Part 4 of the Act. (3) Conditions of exemption— In relation to each lot in the Apartments— (a) a separate title is issued under the BuildingUnitsandGroupTitles Act 1980 ; and (b) if the lot is occupied—a lease for the life of the occupier is registered under the Real Property Act 1861 over the lot in favour of the occupier of the lot; and (c) if the lot is occupied—a first mortgage is registered under the Real Property Act 1861 over the lot in favour of the occupier of the lot. ’.
