An Act to amend the Retail Trading Hours Act 1987 and for related purposes.

[Assented to 3 July 2012]

The Parliament of Western Australia enacts as follows:

Retail Trading Hours Amendment Act 2012

s. 1

1.             Short title

This is the Retail Trading Hours Amendment Act 2012.

2.             Commencement

This Act comes into operation as follows —

(a)	sections 1 and 2 — on the day on which this Act receives the Royal Assent;
(b)	the rest of the Act — on a day fixed by proclamation.

3.             Act amended

This Act, other than section 7, amends the Retail Trading Hours

Act 1987.

4.             Section 12 amended

(1) Delete section 12(3)(c) and insert:

(c) on Sunday in each week, until 11 a.m. and from and after 5 p.m.; and

(2) In section 12(4):

(a)	in paragraph (a) delete “special trading precinct or”;
(b)	delete paragraph (b).

5.             Section 12A amended

(1)

In section 12A(1) and (2) delete “special trading precinct or”

(each occurrence).

(2)

Delete section 12A(3).

(3)

In section 12A(4) delete the definitions of:

Armadale special trading precinct

Fremantle special trading precinct

Joondalup special trading precinct

Midland special trading precinct

Perth special trading precinct

special trading precinct

(4)	Delete section 12A(5).
Note: The heading to amended section 12A is to read:

Trading hours for general retail shops in holiday resorts

6.             Section 12E amended

(1)	Delete section 12E(2) and insert:
(2) Without limiting the effect of subsection (3A), but despite any other provision of this section, an order can vary the trading hours of general retail shops in the metropolitan area only in relation to a day that is —

(a)	within the period of 28 days ending on 1 January; or
(b)	a public holiday or public half-holiday outside that period.

(3A)

An order cannot authorise general retail shops in the

metropolitan area to be open on Anzac Day (25 April),

Christmas Day (25 December) or Good Friday.

In section 12E(3) delete “Subject to subsection (2), an” and

insert:

In section 12E(8) insert in alphabetical order:

(No. 2) 2010 is repealed.
