Restraint of Debtors Amendment

Regulations 2005

Made by the Governor in Executive Council.

1.             Citation

These regulations are the Restraint of Debtors Amendment
Regulations 2005.

2.             Commencement

These regulations come into operation on the day on which the
Courts Legislation Amendment and Repeal Act 2004 comes into
operation or on the day of their publication in the Gazette,
whichever is the later.

3.             The regulations amended

The amendments in these regulations are to the Restraint of
Debtors Regulations 1986*.

4.             Regulation 2A inserted

After regulation 2 the following regulation is inserted —

“

2A.	Term used in these regulations
In these regulations —
“section” means section of the Act.

”.

5.             Regulation 8 amended

Regulation 8 is amended by inserting after “Form 5” —

“ in the Schedule ”.

6.             Regulation 9 amended

Regulation 9 is amended by inserting after “Form 6” —

“ in the Schedule ”.

7.             Regulation 10 amended

Regulation 10 is amended by inserting after “Form 7” —

“ in the Schedule ”.

8.             Regulation 11 amended

Regulation 11 is amended by inserting after “Form 8” —

“ in the Schedule ”.

9.             Regulation 13 replaced

Regulation 13 is repealed and the following regulation is
inserted instead —

“

13.           Fees

The fee to be paid in respect of the execution or
attempted execution of a warrant is the fee set out in
the Magistrates Court (Fees) Regulations 2005
Schedule 1 Division 3 item 3(b).

”.
