[ASSENTED TO 71H DECEMBER, 1912.] B I E it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis- lative Council and Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows : - 1. This Act may be cited as "The Restoration ()f Short title. State Patents Act of 1912," and shall be read as one with " The Patents, Designs, and Irade Marks Act, 1884,"* herein referred to as the Pri:J;lCipal Act. 2.. (1.) When, whether before or after the passing Restoration of this Act, any patent has ceased under section twenty of ~ atents. of the Principal Act owing to the failure of the patentee!. ~ g, : : ~ J.I. to make any prescribed payment within any prescribed ' time, the patentee may apply in writing to the Clerk of the Executive Council for an Order of the Governor.in Council for the restoration of the patent. (2.) Every such application shall contain a statement· of the circumstances which have led to the omission of the prescribed payment. (3.) If it appears from such statement that the omis- sion was unintentional, such Clerk shall advertise the application in the Gazette, and within two months after such advertisement any person may give written notice of objection at the office of such Clerk. \ (4.) Where such notice :is given, such Clerk shall notify the applicant thereof, and the applicant may within twenty-one days after receipt of such notice reply in .w:riting.,to-Ruch ohjection. ~ ____._____ ---____... ..... .. ___ .1< .48 Vic. 6694 PATENTS.-POLICE. Police Acts Amendment Act. 3 GEO. V. No. 32, (5.) After:the expiration of the prescribed period, the Governor in Council shall consider the application and any objection thereto, and any reply to such objection, and shall issue an Order either restoring the patent or dismissing the application: Provided that, in every Order under this section restor- ing a patent, provisions shall be inserted that persons who have actually made and put the patented invention into practice in Queensland after the patent had ceased, and before the publication of a notification in the Gazette of the Order restoring the patent, shall not be liable for infringement of the patent. (G.) Forthwith after any such Order is made such Clerk shall transmit a copy thereof to the officer in charge of the llegister of Patents, and such officer shall, on payment of all fees then due with respect to the patent, re'ltore the same on the said Register; and, save as last aforesaid, such restoration shall have the same effect as if the patentee had complied in all respects with the provisions of the Principal Act relating to p~ ments.
