GLEESON CJ:   This proceeding was heard in Canberra on 11 May 2000 by a Court constituted by Justices Gaudron, McHugh, Gummow, Kirby, Hayne, Callinan and myself. 

On 25 May 2000, the Court pronounced its orders and stated that it would publish reasons for its decision later.  I now publish the joint reasons of Justices Gaudron, McHugh, Gummow, Hayne, Callinan and myself.  I also publish the reasons of Justice Kirby.

On 25 May 2000, the Court also stated that the first, second and third defendants must pay the plaintiff’s costs of the case stated and that any other questions of costs in this Court are reserved for the consideration of a single Justice making orders consequential upon the answers to the questions reserved. 

The matter will be listed for hearing for further directions before Justice Gummow on 16 June 2000 at 9.30 am in Canberra, Canberra time.  The Court will adjourn.
