His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Residential Tenancies Act 1987.

Explanatory note
The object of this Regulation is to exempt the Home Purchase Assistance Authority from compliance with sections 35 and 43 of the Residential Tenancies Act 1987 in respect of certain tenants only. Those sections deal with the recognition of certain persons as tenants and with premium rent terms.
This Regulation is made under section 133 (3) (d) of the Residential
Tenancies Act 1987.

1 Name of Regulation
This Regulation is the Residential Tenancies (Residential
Premises) Amendment (Exemption) Regulation 1997.
2 Amendment of Residential Tenancies (Residential Premises) Regulation 1995
The Residential Tenancies (Residential Premises) Regulation
1995 is amended as set out in Schedule 1.

24 Exemptions relating to the Home Purchase Assistance
Authority
(1) The Home Purchase Assistance Authority is exempted from the operation of sections 35 and 43 of the Act in respect of residential tenancy agreements entered into with tenants who were, at the time of entering into the agreement, categorised as Category C borrowers €or the purposes of implementing the restructuring scheme established under the Home Fund Restructuring Act 1993. (2) The exemptions created by this clause apply to a residential tenancy agreement entered into between the Home Purchase Assistance Authority and any such tenant, whether that agreement was entered into before or after the commencement of this clause.
