REVESTMENT ACT (No. 2)

No. 64 of 1986

AN ACT relating to certain reserves and other land.

[Assented to 28 November 1986]

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

Short title

1. This Act may be cited as the Reserves and Land Revestment Act (No. 2) 1986.

Commencement

2.     This Act shall come into operation on the day on which it receives

the Royal Assent.

Reserve No. 24969 at Swanview

3.

Reserve No. 24969, classified as of Class A, containing 1.153 4 hectares and set apart for "Recreation" is hereby cancelled.

Reserve No. 30826 at Hamelin Bay

4.

Reserve No. 30826, classified as of Class A, set apart for "National Park" and vested in the National Parks and Nature Conservation Authority is hereby amended by including a portion of land between high water mark and low water mark so that the reserve comprises an area of 328.077 1 hectares or thereabouts being Sussex Location 4799 as shown bordered red on Reserve Diagram No. 583, held by the Department of Land Administration.

Reserve No. 29729 at Geraldton

Reserve No. 29729, classified as of Class A, containing 4.249 2 hectares or thereabouts, set apart for "Public Recreation" and vested in the Town of Geraldton is hereby amended by including an area of 8 241 square metres being Geraldton Lot 2859 as surveyed and shown on Diagram No. 86672, held by the Department of Land Administration.

Reserve No. 24653 at Flinders Bay

Reserve No. 24653, classified as of Class A, containing 5.099 0 hectares or thereabouts, set apart for "Recreation and Camping" and vested in the Shire of Augusta-Margaret River is hereby amended by including an area of 1 197 square metres being Augusta Lot 850 as surveyed and shown on Diagram No. 87238, held by the Department of Land Administration.

Reserve No. 21451 at Hamelin Bay

Reserve No. 21451, classified as of Class A, set apart for "National Park" and vested in the National Parks and Nature Conservation Authority is hereby amended by including a portion of land between high water mark and low water mark so that the reserve comprises an area of 790.077 8 hectares or thereabouts being Sussex Locations 3843, 4546, 4606 and 4798 as shown bordered red on Reserve Diagram No. 582, held

by the Department of Land Administration.

Reserve No. 24482 at William Bay

8. Reserve No. 24482, classified as of Class A, set apart for "National Park" and vested in the National Parks and Nature Conservation Authority is hereby amended by including

(a)	a portion of closed road;
(b)	a portion of vacant Crown land; and
(c)	a portion of land between high water mark and low water mark,

so that the reserve comprises an area of 1 705 hectares or thereabouts being the whole of Plantagenet Locations 7595 and 3362 as shown bordered red on Reserve Plan No. 261, held by the Department of Land Administration.

Pallarup Nature Reserve near Lake King

9. Reserve No. 29860, classified as of Class A, containing 3 248.115 9 hectares, set apart for "Conservation of Flora and Fauna" and vested in the National Parks and Nature Conservation Authority is hereby amended by including

(a)	a portion of closed road; and
(b)	a portion of vacant Crown land,

so that the reserve comprises an area of 4 190.657 1 hectares being Roe Location 3099 as shown bordered red on Plan No. 16314, held by the Department of Land Administration.

Reserve No. 24258 at Albany

10. Reserve No. 24258, classified as of Class A, containing 3 813.035 6 hectares or thereabouts set apart for "National Park and Recreation" and vested in the National Parks and Nature Conservation Authority is hereby amended by including

(a)	an area of 58.922 7 hectares comprising Plantagenet Location 7401; and
(b)	an area of 1.870 8 hectares comprising Plantagenet Location 7592,

as surveyed and shown on Plan No. 14407, held by the Department of

Land Administration.

Reserve No. 27004 at Kalbarri

Reserve No. 27004, classified as of Class A, set apart for "National Park" containing 186 054.451 5 hectares or thereabouts and vested in the National Parks and Nature Conservation Authority is hereby amended by excising an area of 5 134 square metres being Victoria Location 11673 as shown bordered green on Diagram No. 87309, held by the Department of Land Administration.

Reserve No. 26741 in the City of Perth

Reserve No. 26741, classified as of Class A, containing 6.649 5 hectares and set apart for "the use and requirements of the Parliament and Government" is hereby amended by excising an area of 6 701 square metres being Perth Lot 972 as surveyed and shown on Diagram No. 87481, held by the Department of Land Administration.

Reserve No. 30082 near Wittenoom

Reserve No. 30082, classified as of Class A, set apart for "National Park—Dales Gorge" and vested in the National Parks and Nature Conservation Authority is hereby amended by excising an area of 4.400 0 hectares being Windell Location 84 as shown bordered green on Miscellaneous Diagram No. 122, held by the Department of Land Administration.

Reserve No. 35815 at Perth

14.

(1) Reserve No. 35815, classified as of Class A, containing 6.507 1 hectares, set apart for "Vehicle Park and Gardens" and vested in the City of Perth is amended by excising an area of 2 134 square metres being the area shown bordered red on Miscellaneous Diagram No. 121, held by the Department of Land Administration.

(2). The purpose of Reserve No. 35815 is hereby changed to "Vehicle Park, Gardens and Bus Terminal".

Reserve No. 17862 at Melville

15.

The purpose of Reserve No. 17862, classified as of Class A, containing 1.302 6 hectares, set apart for "Recreation" and vested in the

City of Melville is hereby changed to "Recreation and Drainage".

Foundation Park at Albany

16. (1) In this section the land known as "Foundation Park" at Albany, held for an estate in fee simple upon trust for the purposes of a place of Recreation for the inhabitants of the Town of Albany forever, being all the land described in Certificate of Title Volume VIII Folio 86, is referred to as "the specified land".

(2) The specified land is hereby freed and discharged from the trust referred to in subsection (1) and shall be hereafter held upon trust for the purposes of recreation.

(3) The Registrar of Titles appointed under section 7 of the Transfer of. Land Act 1893 shall, upon the delivery to him of the duplicate of the certificate of title referred to in subsection (1), cancel that certificate of title and make out a new certificate of title in accordance with subsection (2).

Reserve No. 24674 at Corrigin

17. (1) Reserve No. 24674, classified as of Class C, comprising the land described in Certificate of Title Volume 1672 Folio 984, held for an estate in fee simple by The St. John Ambulance Association in Western Australia Incorporated ("the Association") upon trust for "Ambulance Depot", shall, upon the Registrar of Titles making out a new certificate of title under subsection (2), be freed and discharged of that trust and, may be dealt with for an estate in fee simple accordingly.

(2) The Registrar of Titles appointed under section 7 of the Transfer of Land Act 1893 shall upon

(a)	the delivery to him of the duplicate of the certificate of title issued under that Act in respect of the land comprised in Reserve No. 24674; and
(b)	being satisfied that the Association has paid to the State an amount of $2 000 in consideration of the discharge of the trust referred to in subsection (1),

cancel that certificate of title and make out to the Association a certificate of title to the land freed and discharged from the trust referred

to in subsection (1).

Land revested in Her Majesty

18. (1) All that land specified in the Table to this section is hereby revested in Her Majesty as of Her former estate and removed from the operation of the Transfer of Land Act 1893, and is constituted Crown land within the meaning of that expression in the Land Act 1933.

(2) The reservation under section 20A of the Town Planning and Development Act 1928 of the land specified in the Table is hereby

cancelled.

(3) Part VIIA of the Land Act 1933 applies to land constituted Crown land under subsection (1) as if that land were land comprised in a road that is closed as being no longer required as a road.

TABLE

1. City of Armadale

The pedestrian accessway containing 271 square metres shown bounded by Lots 41, 42, 55 and 56 on Office of Titles Plan No. 9277 and extending between Angelo Street and Forrest Road on that plan.

2. City of Bayswater

The land in the right-of-way being 593 square metres shown abutting Lot 28 on Office of Titles Diagram No. 47787 and extending between Drake Street and Reserve No. 28252 on that diagram.

3. City of Canning

The pedestrian accessway containing 221 square metres shown bounded by Lots 37 and 38 on Office of Titles Diagram No. 48608, and Lots 49 and 50 on Office of Titles Plan No. 11229 and extending between Dutton Close and Gallant Way on that diagram and plan.

4. City of Wanneroo

The pedestrian accessway containing 702 square metres shown bounded by lots 220, 221, 229 and 230 on Office of Titles Plan No. 12576 and extending between Dellamarta Road and Prindiville Drive on that plan.
