AN ACT relating to certain reserves and other

lands.

[Assented to 27 May 1982.]

BE it enacted by the Queen's Most ExcellentMajesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

1.    This Act may be cited as the Reserves and Short title.

Reserve No. 8550, classified as of Class A, containing 16.946 2 hectares, set apart for "Stopping	8550 at

Reserve No. 6638, classified as of Class A, containing 77.851 4 hectares, and set apart for "Recreation", is hereby amended by excising an area of 1.098 0 hectares comprising Fremantle Lot 1995.

Augusta. A, containing 6.257 5 hectares, set apart for 11533 at at 5. Reserve No. 11533, classified as of Class

"Parklands and Recreation" is hereby amended by

excising

(a) an area of 6 991 square metres that is surveyed as a road and shown coloured dark brown on Lands and Surveys Original Plan No. 15150 and contained in the reserve;

and

(b) an area of 9 513 square metres comprising Augusta Lot 828.

20091 south	6. (1) Reserve No. 20041, classified as of Class A, containing 583.152 0 hectares, set apart for "Protection of Indigenous Flora", and placed under the control of the National Parks Authority of Western Australia, is hereby amended by excising
of Tammin.

(a) an area of 2 363 square metres being all that portion of Avon Location 28711 that is contained in the reserve;

and

(b) an area of 3 367 square metres that is surveyed as a road and shown coloured brown on Lands and Surveys Diagram 84844 and contained in the reserve.

Avon Location 28711 for an estate in fee simple to the registered proprietor of Avon Location 26778 in exchange for an area of 2 872 square metres being the portion of Avon Location 28710 not shown coloured blue on Lands and Surveys Diagram 84843.	(2)	The Governor may grant the land comprising

Upon the transfer to the Crown of the portion of Avon Location 28710 referred to in subsection (2) of this section, that land is revested in Her Majesty as of Her former estate and is removed from the operation of the Transfer of Land Act 1893 and the land comprising Avon Location 28710 shall thereupon, by operation of this subsection, be included in Reserve No. 20041.

7. (1) Reserve No. 19801, classified as of Class 19801 and 24505 near

C, containing 20.23 hectares or thereabouts, set	Shack/eton.
apart for "Rubbish Depot", is hereby cancelled.
(2) Reserve No. 24505, classified as of Class A, comprising Kwolyin Agricultural Area Lots 338, 400, 407 and 410, containing 447.172 5 hectares, set apart for "Conservation of Flora" is hereby amended by

(a)	including the land referred to in subsection (1) of this section; and
(b)	excising an area of 8.244 9 hectares comprising Kwolyin Agricultural Area Lot 424.

(3) The purpose of Reserve No. 24505 is hereby changed to "Conservation of Flora and Fauna".

8. (1) Reserve No. 29632, classified as of Class C, comprising Gascoyne Location 291, containing

29632 and

19145 at

Carnarvon.

1 416 square metres, set apart for "Pump Site (Public Works Department)", and vested in the Minister for Works, is hereby cancelled.

(2) The land referred to in subsection (1) of this

section is hereby included in Reserve No. 19145,

classified as of Class A, heretofore containing

78.096 9 hectares or thereabouts, set apart for "National Park", and vested in the Shire of Carnarvon.

Reserve No.

24745 at	9. (1) Reserve No. 24745, classified as of Class C, comprising Narrogin Lots 1129 and 1282, containing 675 square metres, set apart for "Ambulance Depot", and held for an estate in fee simple by the St. John Ambulance Association in Western Australia Incorporated upon trust that the land be used and held solely for the purpose of an Ambulance Depot, and described in Certificate of Title Volume 1208 Folio 326, is hereby cancelled.

(2) The land referred to in subsection (1) of this section may be sold and transferred by The St. John Ambulance Association in Western Australia Incorporated for such consideration as it thinks fit, and upon the registration in the Office of Titles of a transfer pursuant to this section the land so transferred is freed and discharged from the trust and the Registrar of Titles appointed under section 7 of the Transfer of Land Act 1893 shall cancel the certificate of title issued under that Act in respect of Narrogin Lots 1129 and 1282 and make out to the transferee a certificate of title to the land so transferred.
Land
revested	10. (1) All that land being portion of Fremantle Town Lots 319, 320, 321 and 336 coloured brown and marked "Pedestrian Access Way" on Office of Titles Plan 8186 and being part of the land comprised in Certificate of Title Volume 1288 Folio 663 is revested in Her Majesty as of Her former estate and removed from the operation of the Transfer of Land Act 1893, and is constituted Crown land within the meaning of that expression in the Land Act 1933.

(2) The reservation of the land referred to in subsection (1) of this section pursuant to section 20A of the Town Planning and Development Act 1928 is hereby cancelled.
