AN ACT relating to Certain Reserves and
other Lands.
[Assented to 17th December, 1963.]
RE it enacted by the Queen's Most Excellent
Majesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

(2) The land comprised in the portion so excised may be included by survey in Boyup Brook Lot 330 which may then be sold to the Shire of Upper Blackwood under the provisions of the Land Act, 1933, in such manner as the Governor may approve.
3. Reserve No. 21380, at Bruce Rock, classified as Dgs:e273to
of Class "A" and set apart for the purposes of Bruce Rock.
"Recreation", is hereby amended by excising the
portions comprising Bruce Rock Lots 44 and 45,
containing an aggregate area of two roods, with the
intention that the portions so excised be set apart
as a separate reserve for the purposes of "Recreation
and Kindergarten".
4. Reserve No. 8485, at Busselton, containing an ggs.e8r4z
area of fifty-six acres two roods thirty-four perches, Bussetton. of the reserve, in the manner as surveyed and shown on Lands and Surveys Original Plan No. 8891.
classified as of Class "A" and set apart for the
purposes of "Camping, Park and Recreation" and
vested in the Shire of Busselton, in trust, for those
purposes, is hereby amended by excising an area
of eight acres one rood eleven perches, for the
purpose of extending Milne, Carey and Georgette
5. Reserve No. 24522, at Cervantes, classified as 1.4n451,
of Class "A" and set apart for the purposes of Cervantes.
"Preservation of Caves and National Park", is
hereby amended by excising the portion now
comprised in Melbourne Location No. 3885, con-
taining an area of one acre three roods twenty-nine
and eight-tenths perches, with the intention that
the portion so excised be reserved for the purpose
of "Water Supply", for the new Townsite of
Cervantes.

Endowment", is hereby vested in the Trustees of the Public Education Endowment, for an estate in fee simple, with authority in the Trustees to subdivide and sell the land, free of all trusts, subject to the proceeds of the sale being invested by them, in accordance with the provisions of the Public Education Endowment Act, 1909.

The purpose of Class "A" Reserve No. 20403, at Denmark, is hereby amended from "Park Lands" to "Recreation", with the intention that the Reserve be vested in the Shire of Denmark, in trust, for the amended purpose, with power, subject to the prior approval of the Minister for Lands, to lease for any term not exceeding twenty-one years.

The purpose of Class "A" Reserve No. 25337, at Denmark, is hereby amended from "Park (Pioneer Park)" to "Park (Pioneer Park) and Kindergarten Site", with the intention that the reserve be vested in the Shire of Denmark, in trust, for the amended purpose.

Reserve No. 11384, at Fremantle, classified as of Class "A", set apart for the purpose of "Public Education Endowment" and held in fee simple, in trust, for that purpose by the Trustees of the Public Education Endowment, is hereby amended, by the excision of Fremantle Lots 1038, 1040, 1042 and 1044, being the whole of the land comprised in Certificate of Title Volume 790 Folio 85; and the Trustees are hereby authorised to sell the lots so excised, free of trust, subject to the proceeds of any sale being invested by them, in accordance with the provisions of the Public Education Endowment Act, 1909.

Supply Sewerage and Drainage, in trust, for the purpose of "Water Supply", is hereby amended
| (a) | to comprise Kalgoorlie Lot 2569, only, and, as resurveyed, to contain fifty-seven acres and twelve perches or thereabouts; and |
| (b) | by the excision of all other portions thereof, with the intention that the portions so excised be reserved in such manner as the Governor may approve, under the provisions of the Land Act, 1933. |
(2) Notwithstanding the provisions of section two of the Permanent Reserves Act, 1913, the land comprised in the reserve, as amended, is hereby revested in Her Majesty as of her former estate, with the intention that it be vested in the Minister for Water Supply, Sewerage and Drainage, by vesting order, under the provisions of section thirty-three of the Land Act, 1933, in such manner as the Governor may approve.
12. Reserve No. 2076, at Mingenew, comprising yin;
Victoria Locations 9764 and 9765, classified as of Mingenew.
Class "A", and set apart for the purposes of "Watering Place, Stock Route and Common for Travellers and Stock", is hereby amended by excis- ing Location 9764, with the intention that the portion excised may be made available for selection under conditional purchase, under the provisions of the Land Act, 1933, in such manner as the Governor may approve.
13. (1) Reserve No. 12070, at Mingenew, com- ite.rivgo
prising Mingenew Lots 31 to 40 inclusive, containing Mingenew.`
two acres two roods, classified as of Class "A", set apart for the purpose of "Public Education Endowment" and held in trust, for that purpose, by the Trustees of the Public Education Endowment, and comprised in Certificate of Title Volume 557 Folio 171, is hereby cancelled and the Trustees are hereby authorised to sell the land, free of all trusts,

to the State Housing Commission, subject to the proceeds of the sale being invested by them, in accordance with the provisions of the Public Education Endowment Act, 1909.
(2) Reserve No. 21556, comprising Mingenew Lots 47 and 48, containing two roods thirteen and a half perches and set apart for the purpose of "Public Education Endowment", is hereby vested in the Trustees of the Public Education Endowment, for an estate in fee simple, with authority to sell the land, free of all trusts, to the State Housing Commission, subject to the proceeds of the sale being invested by them in accordance with the provisions of the Public Education Endowment Act, 1909.

The portion of the reserve so excised is hereby revested in Her Majesty as of her former estate, with the intention that it be disposed of to the Commonwealth of Australia, for the purpose of a National Television Transmitter Site, under the provisions of section seven of the Land Act, 1933.
The balance of Reserve No. 15162 remaining
after the excision provided by this section shall be
identified as Plantagenet Location No. 6923.

the portion, comprising an area of ten acres one rood and thirty-seven perches, that has been included by survey as part of Parkerville Lot 385, as shown on Lands and Surveys Diagram No. 69415.

The portion so excised is hereby revested in Her Majesty as of her former estate and is removed from the operation of the Transfer of Land Act, 1893, with the intention that it be reserved for the purpose of the Parkerville Schoolsite.

Reserve No. 12085 is hereby further amended by the re-inclusion therein of an area of two acres three roods and thirty-seven perches, being the remaining portion of Parkerville Lot 379 and being the portion of cancelled Reserve A.25339 that is not required for the Parkerville Schoolsite, with the intention that the portion so added be again vested in the Trustees of the Public Education Endowment, for an estate in fee simple, in trust, for the purpose of "Public Education Endowment".

fee simple, in the Trustees of the Public Education Endowment.
17. Reserve No. 15962, at Quairading, classified Reserve6,
as of Class "A" and set apart for the purposes of Qu_irading

Reserve No. 7478, at Southern Cross, classi- fied as of Class "A" and set apart for the purpose of "Recreation Ground", is hereby amended by excising Southern Cross Lots 718, 719, 720 and 725, contain- ing an aggregate area of eleven acres and thirty perches, with the intention that the land so excised be reserved for the purpose of a schoolsite.

(1) Reserve No. 17391, comprising South Nedlands Lot 232, containing an area of about fifty- five acres and twenty-seven perches, classified as of Class "A", set apart for the purpose of "Public Recreation" and vested in the City of Nedlands, in trust, for that purpose, under the provisions of section thirty-three of the Land Act, 1933, is hereby amended by excising the portion now surveyed as South Nedlands Lot 252 containing one rood twenty- two perches and being the portion occupied by the building known as "Gallop House".

The land comprised in the portion so excised shall be surveyed as Canning Location No. 1929 and be reserved for the purpose of "Drainage", in such manner as the Governor may approve.

The portions of Reserve No. 24329 remaining, after the excision provided by this section, are redescribed to comprise Canning Locations 1300, 1927 and 1928.
21. Reserve No. 1275, at Wyndham, classified as gg.selr275
of Class "A" and set apart for the purposes of Wyndham.
"Recreation and Parklands", is hereby amended so as to comprise Wyndham Lot 380 and, as re- surveyed, to contain four acres one rood and twenty- five perches, as shown on Lands and Surveys Original Plan No. 9210, with the intention that the excised portions be reserved, leased or alienated under the provisions of the Land Act, 1933, in such manner as the Governor may approve.
22. Reserve No. 20359, at Wyndham, set apart for No520359
the purpose of "Cemetery Site", is hereby amended Wyndham.
so as to comprise Wyndham Lot 441 and, as re- surveyed, to contain three acres three roods and six perches, as shown on Lands and Surveys Original Plan No. 9210, with the intention that the excised portions be reserved, leased or alienated under the provisions of the Land Act, 1933, in such manner as the Governor may approve.
