AN ACT relating to certain reserves and other lands.

[Assented to 22 May 1981.]

BE it enacted by the Queen's Most ExcellentMajesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:-

Short title.

1.    This Act may be cited as the Reserves Act 1981.

The purpose of Reserve No. 12098, classified as of Class A, containing 35.612 3 hectares, and set

Reserve No. 8613, classified as of Class A, containing 56.656 0 hectares, set apart for "Park", and placed under the control and management of the Shire of Greenough, is hereby amended by excising an area of 23.332 4 hectares comprising Victoria Location 11438.

The purpose of Reserve No. 27310, classified as of Class A, containing 42.896 7 hectares, and set apart for "Preservation of Indigenous Timber", is hereby changed to "Conservation of Flora and Fauna".

Reserve No. 27575, classified as of Class A, containing 1 077.991 2 hectares or thereabouts, set apart for "National Park", and vested in the National Parks Authority of Western Australia, is hereby amended by excising an area of 51.884 6 hectares comprising Swan Location 10122.

Reserve No. 2851, classified as of Class A, containing 123.046 1 hectares, set apart for "Recreation and Camping", and vested in the Shire of Mandurah, is hereby amended by excising an area of 3 hectares comprising Murray Location 1720.

Reserve No. 31362, classified as of Class A, containing 17 715.723 4 hectares or thereabouts, set apart for "National Park", and placed under the control of the National Parks Authority of Western Australia, is hereby amended by excising an area of 6.135 2 hectares comprising Nelson Location 13207.

land. comprising portion of Kalgoorlie Town Lot 510, containing 8 094 square metres or thereabouts, set apart for "Hospital (St. John)", and held for an estate in fee simple by the Sisters of St. John of

God Inc. upon trust that the land shall be used and held solely for the purposes of the Hospital of Saint John of God, is hereby cancelled.

(2) The portion of Kalgoorlie Town Lot 510 being Lot 1 on deposited diagram 59799 in the Office of Titles, held for an estate in fee simple by the Sisters of St. John of God Inc. upon trust that the land shall be used and held solely for the purposes of the Hospital of Saint John of God, may be sold and transferred by the Sisters of St. John of God Inc. for such consideration as they think fit, and upon the registration in the Office of Titles of a transfer pursuant to this subsection

(a)

the land so transferred is freed and discharged from the trust and the Registrar of Titles appointed under section 7 of the Transfer of Land Act 1893 shall cancel the certificate of title issued under that Act in respect of Kalgoorlie Town Lot 510 and make out to the transferee a certificate of title to the land so transferred; and

(b)

the portion of Kalgoorlie Town Lot 510 being Lot 2 on deposited diagram 59799 in the Office of Titles, held for a like estate by the Sisters of St. John of God Inc. upon a like trust, is freed and discharged from the trust, is revested in Her Majesty as of Her former estate, is removed from the opera- tion of the Transfer of Land Act 1893, and is constituted Crown land within the meaning of that expression in the Land Act 1933.
