AN ACT relating to certain Reserves and other

Lands.

[Assented to 25th November, 1969.]

BE it enacted by the Queen's Most ExcellentMajesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

1.    This Act may be cited as the Reserves Act, Short title.

2.    (1) Reserve No. 9914 at Broome, comprising Allege No.

Broome Lot 136, containing two roods sixteen Broome. perches, classified as of Class "A", set apart for the purpose of "Mechanics Institute", and held in trust

for the purposes of a Literary Institute by the Mayor and Councillors of Broome under Lease No. 402/42 granted under the Land Act, 1898 for a term of nine hundred and ninety-nine years is reclassified as of Class "C" with the intention that the Governor may set apart separate reserves or otherwise dispose of any portion in accordance with the provisions of the Land Act, 1933.

(2) Lease No. 402/42 granted under the Land Act, 1898 is cancelled.

3. (1) Reserve No. 12636 at Bunbury containing

Bunbury. apart for the purpose of "Recreation", and vested

in the Bunbury Town Council is amended by excising an area of approximately eight acres from Anglesea Island to be surveyed as Bunbury Lot 505, as shown on Lands and Surveys Plans Bunbury Sheets 1 and 2.

(2) The land excised by the operation of subsection (1) of this section shall be reserved for the purpose of "Bunbury Harbour Extensions" with the intention that it be vested in the Bunbury Port Authority.

4. (1) Reserve No. 15927 at Bunbury, comprising Bunbury Lot 380, containing about twelve acres, classified as of Class "A", set apart for the purpose of "Recreation", and under the control of the Town of Bunbury as a Board of Management appointed under the Parks and Reserves Act, 1895 is amended by excising that portion of the reserve containing about two and three tenths perches that is contiguous to Lot 361 on Lands and Surveys Plan CD No. 64 and that is included in the area shown coloured green on that plan.

(2) The Governor is authorised to lease the land excised by the operation of subsection (1) of this

section to the Bunbury Yacht Club Incorporated of

(3) The purpose of Reserve No. 15927, as amended by subsection (1) of this section, is altered to "Re- creation and Parking" and the authority of the Town of Bunbury as a Board of Management under the Parks and Reserves Act, 1895 is cancelled with the intention that the land remaining in the reserve be vested in the Town of Bunbury, for that purpose, with power to lease for any period not exceeding twenty-one years.

(2) The land excised by the operation of sub- section (1) of this section shall be included in Class "A" Reserve No. 24653, which is vested in the Augusta-Margaret River Shire Council for the purpose of "Recreation and Camping".

(2) The land excised by the operation of subsec- tion (1) of this section shall be reserved as a "Pound Site" with the intention that the reserve be vested in the Shire of Rockingham.

Lake Clif ton. comprising Wellington Location 4631, containing

forty-eight acres and twenty-four perches, classified as of Class "A", set apart for the purpose of "Camping and Recreation", and vested in the National Parks Board of Western Australia, is cancelled.

(2) The land available from the reserve that is cancelled by the operation of subsection (1) of this section shall be included in the Yalgorup National Park Reserve No. 11710, which is classified as of Class "A" and set apart for the purpose of "National Park".

(1) Reserve No. 4379, Malcolm, containing two hundred and seventy acres, classified as of Class "A", set apart for the purpose of "Racecourse", and held in trust for that purpose, under Certificate of Title Volume 204 Folio 139, for a term of ninety-nine years, registered in the names of Peter Hill, Joseph George Walsh, and Francis Gillett Brewer, as Trustees of the Malcolm Racing Club, is cancelled.

(2) The land available from the reserve that is cancelled by the operation of subsection (1) of this section is revested in Her Majesty, as of her former estate, and is removed from the operation of the Transfer of Land Act, 1893, with the intention that it be included in Reserve No. 7521, for the purpose of "Commons", and under the control of the Leonora Shire Council.

(1) Reserve No. 27956, comprising Plant- agenet Locations 6744, 5409, 7065, 5394, 3985, 5368, 7068, 7069, 7070, 7066, containing eleven thousand four hundred and sixty acres, classified as of Class "A", set apart for the purpose of "Conservation of Fauna—Noisy Scrub Bird", and vested in the "Fauna Protection Advisory Committee" is amended by excising an area of approximately six-tenths of an acre to be described by aerial photographs as Plant- agenet Location 7132 and bordered green on Lands and Surveys Plan 451 C/40.

(1) Reserve No. 21534 at Cranbrook, compris- ing Plantagenet Location 4855, containing seventy- nine acres and twelve perches, classified as of Class "A", set apart for "Agricultural Show Grounds", and held by the Cranbrook and District Agricultural Society Incorporated under a Crown Grant specified in Certificate of Title Volume 1047 Folio 710 regis- tered in the name of the trustees Francis Eric Hitchins and John Thomas Newton is cancelled.
