AN ACT relating to certain Reserves and other

Lands.

[Assented to 5th December, 1967.]

BE it enacted by the Queen's Most ExcellentMajesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

1.    This Act may be cited as the Reserves Act,1967. Short title.

(2) The land excised by the operation of subsection (1) of this section shall be made available for exchange purposes under section eight of the Land Act, 1933, in such manner as the Governor may approve.

(2) The land excised by the operation of subsection (1) of this section shall be added to the contiguous Drain Reserve.

7.    (1) Reserve No. 11379, classified as of Class "A" Res No.

(2) The land excised by the operation of subsection (1) of this section may be made available to the North Cottesloe Surf Life Saving Club Incorporated, in such manner as the Governor may approve, under the provisions of the Land Act, 1933.

(2) The land excised by the operation of subsection (1) of this section shall be included in the contiguous Reserve No. 27530 set apart for the purpose of "Caravan Park".

Reserve No. 10.

(1) That portion of Reserve No. 12083, at South Kalamunda, classified as of Class "A" and set apart for the purpose of a Public Education Endow- ment and held in fee simple by the Trustees of the Public Education Endowment, under Certificate of Title Volume 1317 Folio 161, is hereby amended by excising Lot 1 of Kalamunda Lot 111 containing one acre two roods thirty-seven and six-tenths perches, surveyed and shown on Lands and Surveys Diagram No. 72379.

(2) The Trustees of the Public Education Endow- ment may sell the land excised by the operation of subsection (1) of this section to the State Electricity Commission of Western Australia, f reed and discharged of all trusts, subject to the proceeds of the sale being invested in accordance with the provisions of the Public Education Endowment Act, 1909.

(1) Reserve No. 2077 at Mosman Park, classified as of Class "A" and set apart for the purpose of "Recreation" and vested in the Town of Mosman Park, in trust, for that purpose, under the provisions of section thirty-three of the Land Act, 1933, is hereby reclassified as of Class "C".

(2) The land excised by the operation of subsection (1) of this section shall be reserved for the purpose of "Recreation".

(1) Reserve No. 22240, in Perth, containing four acres two roods and thirty-two perches, classified as of Class "A" and set apart for the purpose of "Public Buildings", is hereby amended by excising an area of two roods twenty-five and four-tenths perches, more or less, to be surveyed as Perth Town Lot 842.	22290 Perth.
(2) The land excised by the operation of subsection (1) of this section shall be reserved for the purpose of a "Concert Hall and Associated Uses" in such manner as the Governor may approve, under the provisions of the Land Act, 1933.

(2) Reserve No. 25446, at Powlalup, classified as of Class "A" and set apart for the purpose of "Conservation of Flora and Fauna" and vested in The Fauna Protection Advisory Committee of Western Australia, is hereby amended by the excision of those portions containing in the aggregate approximately fifty-five acres, subject to survey, as coloured green on Lands and Surveys Miscellaneous Plan 403.

The lands excised by the operation of subsections (1) and (2) of this section may be made available for forestry purposes in such manner as the Governor may approve.

15962 at	15. (1) Reserve No. 15962 classified as of Class "A" and set apart for the purpose of "Park Lands and Recreation" is hereby amended by the excision of an area of one rood two and nine-tenths perches, now surveyed as Quairading Lot 298.

(2) The land excised by the operation of subsection (1) of this section shall be reserved for the purpose of a "Fire Station".

(1) Reserve No. 11290 classified as of Class "A", set apart for the purpose of "Camping Ground and Resting Place for Travellers and Conservation of Indigenous Timber and Flora" and vested in the Shire of Plantagenet, is hereby amended by the excision of five acres one rood thirteen perches as shown on Lands and Surveys Diagram No. 72375.

(2) The portion of land designated Hay Location 2285 and containing five acres excised by the operation of subsection (1) of this section shall be set apart as a reserve for the purpose of a "Cemetery Site".

The portion of land shown coloured dark brown on Lands and Surveys Diagram No. 72375 and containing one rood thirteen perches excised by the operation of subsection (1) of this section shall be provided for access purposes.

12071 at	17. (1) Reserve No. 12071, at Roebourne, classified as of Class "A" and set apart for the purpose of Educational Endowment, is hereby amended by the excision of Roebourne Lots 278 to 289, inclusive, containing an area of six acres, being portion of the land comprised in Certificate of Title Volume 570 Folio 65.

(2) The land excised by the operation of subsection (1) of this section is hereby revested in Her Majesty as of her former estate and is removed from the operation of the Transfer of Land Act, 1893.

(3) The land revested by the operation of subsection (2) of this section shall be set apart, together with other contiguous land, as a reserve for the purpose of "Effluent Disposal".

18. (1) Reserves 3355, 8615, 8650, 8651, 20357, =at.

21904 and 23894 each classified as of Class "A" are

hereby cancelled.

The reserves cancelled by the operation of subsection (1) of this section are hereby amalgamated into one composite reserve, classified as of Class "A" and set apart as Reserve No. 28862 for the purpose of "National Park".

(3) The Governor is authorised to vest Reserve No. 28862 in the National Parks Board of Western Australia, in trust, for the purpose of "National Park".

19. (1) Reserve No. 9868, at Yanchep, containing 1913e6serve No.

six thousand two hundred and ninety-one acres Yanchep.

three roods twenty-three perches, classified as of Class "A" and set apart for the purposes of "Protection and Preservation of Caves and Flora, and for Health and Pleasure Resort", is hereby amended by excising Swan Location 8240 containing thirty- seven acres, more or less, subject to survey.

(2) The land excised by the operation of subsection (1) of this section shall be reserved under the provisions of the Land Act, 1933, for the purpose of "Forestry Headquarters Site", and shall be vested in the Conservator of Forests, in trust, for that purpose.
