AN ACT relating to certain Reserves and other

Lands.

[Assented to 12th December, 1966.]

BE it enacted by the Queen's Most ExcellentMajesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

1. This Act may be cited as the Reserves Act,1966. Short title.

Reserve

(1) Reserve No. 24258, near Albany, contain- ing about nine thousand and eighteen acres, classi-	No. 24258,

(a) an area containing forty-seven acres three

starting from the south-eastern corner of Plantagenet Location 393 and extending northerly along the eastern boundary of that location to the southern side of Frenchman Bay Road (Road Number 3312) ; thence generally south-easterly along that side of that Road to the western corner of the southern severance of Location 112; thence south to a point situate in prolonga- tion easterly of the southern boundary of Location 393 aforesaid; thence westerly along that prolongation to the starting point;

(b)	an area containing fifty acres and thirty- two perches now surveyed as Plantagenet Location 6993 as shown on Lands and Surveys Diagram No. 71203; and
(c)	an area containing five acres and thirty- two perches as shown coloured brown on Lands and Surveys Diagram No. 71203.

The portion of Reserve No. 24258 excised by the operation of paragraph (a) of subsection (1) of this section shall be reserved for the purpose of a "Rubbish Disposal Site" and be vested in the Shire of Albany, in trust, for that purpose.

The portion of Reserve No. 24258 excised by the operation of paragraph (b) of subsection (1) of this section shall be reserved for the purpose of a "Gravel Quarry" and be vested in the Shire of Albany, in trust, for that purpose.

Class "A" and set apart for the purpose of "Public Park", is hereby amended by excising an area of eight acres and two perches more or less, to be surveyed as Albany Lots 1188, 1189, 1190 and 1191, with the intention that the excised land be set apart as a separate reserve for "Service Tank and Pipe Lines", and vested in the Minister for Water Supply, Sewerage and Drainage, by vesting order, under the provisions of section thirty-three of the Land Act, 1933, in such manner as the Governor may approve.

(2) The land comprised in the portions so excised from the reserve shall be set apart as separate reserves under the provisions of the Land Act, 1933, in such manner as the Governor may approve.

the Trustees of the Public Education Endowment under Certificate of Title Volume 812, Folio 98, is hereby cancelled.

(2) The land comprised in portion of Cottesloe Lot 9 and held in Certificate of Title Volume 812, Folio 98, may be disposed of by the Trustees of the Public Education Endowment free of all trusts, subject to the proceeds of the sale being invested in accordance with the provisions of the Public Education Endowment Act, 1909.

10. (1) Reserve No. 8589, comprising Fremantle Town Lots 1511 and 1512, containing thirty-seven and eight-tenths perches, set apart for the purposes of the "Fremantle and Districts Trades Hall" and held in fee simple, in trust, in Certificate of Title Volume 277, Folio 135, by The Fremantle and District Trades Hall Industrial Association of Workers, is hereby cancelled.	Fremantle.
(2) Fremantle Town Lots 1511 and 1512, com- prised in the Certificate of Title mentioned in subsection (1) of this section, are hereby revested in Her Majesty as of her former estate and are removed from the operation of the Transfer of Land Act, 1893.

The Governor is hereby authorised to issue a Crown Grant for Fremantle Town Lots 1511 and 1512 to The Perth Trades Hall Incorporated, freed and discharged of all trusts, with the intention that the property may be sold and the proceeds of such sale held in trust for the purpose of building a Trades Hall at Fremantle.

(1) Reserve No. 9093, comprising Kala- munda Lot 85 and containing thirty-four acres three roods twenty perches classified as of Class "A" and set apart for the purposes of "Parklands and Recreation" is hereby reclassified as of Class "C" with the intention that the Governor may amend the Reserve under the provisions of section thirty- seven of the Land Act, 1933, by excising portion of that Reserve for subdivision under and in accord- ance with the provisions of the Town Planning and Development Act, 1928.

(2) The remaining portion of Reserve No. 9093 and any land contained within Swan Location 4141 that is surrendered to the Crown shall, after amend- ment of the Reserve, be reclassified as of Class "A", by Proclamation.

(2) The portion of Reserve No. 13045 so excised shall be reserved for the purpose of "Caravan Park" and vested in the Shire of Denmark under the provisions of the Land Act, 1933, in such manner as the Governor may approve.

(1) Reserve No. 16606, being Scaddan Lot 34, containing nine acres three roods, set apart for the purpose of "Recreation" and under the control and management of Frederick Gilmore, Thomas Crosborough Henchman and Gustav Holznagel as a Board in accordance with the provisions of the Parks and Reserves Act, 1895, is hereby cancelled, and the appointment of the Board revoked.

Wagerup Lots 46, 47, 48 and 49, comprised in the Certificate of Title mentioned in subsection (1) of this section, are hereby revested in Her Majesty as of her former estate and are removed from the operation of the Transfer of Land Act, 1893.

The land revested by the operation of sub- section (2) of this section shall be subdivided to provide a widening of South Western Highway, necessary road truncations and an Irrigation Channel Reserve.

(4) The balance of the area subdivided by the authority of subsection (3) of this section shall, together with abutting closed roads, be renumbered as Wagerup Lots 121 and 122 and the Governor is hereby authorised to issue a Crown Grant for those lots to the Trustees of the Public Education Endowment, freed and discharged of all trusts, with the intention that the land may be disposed of in accordance with the provisions of the Public Education Endowment Act, 1909.

26.

(1) Perth Lot 837, comprising an area of two and one-half perches and shown on Lands and Surveys Original Plan No. 10326, is hereby set apart and dedicated as Reserve No. 28330 for the Use and Requirements of The Commissioners of the Rural and Industries Bank of Western Australia in perpetuity and the Reserve No. 28330 is hereby classified as of Class "A".	Lot 837.
(2) The Governor shall issue and is hereby authorised to issue to the Commissioners a Crown grant of Perth Lot 837 in trust for the use and requirements aforesaid, and subsection (2) of section twenty-nine of the Land Act, 1933, shall not apply to the land comprised in Perth Lot 837.
