AN ACT relating to certain Reserves and

other Lands.

[Assented to 30th November, 1962.]

RE it enacted by the Queen's Most Excellent

Majesty, by and with the advice and consent

of the Legislative Council and the Legislative

Assembly of Western Australia, in this present

Parliament assembled, and by the authority of the

same, as follows:—

Short title

1.

This Act may be cited as the Reserves Act,

and citation.

Reserve No. 2682, at Albany, classified as of Class "A" and set apart for the purpose of "Public

Park", is hereby reduced by the excision of the portion now surveyed as Albany Lot 1139, containing two roods thirty-four and eight-tenths perches, with the intention that the excised portion be set apart as a separate reserve for the purpose of "Anzac War Memorial site."

3. (1) Reserve No. 6962, at Bunbury, classified as of Class "A" and set apart for the purpose of "Harbour and River Wharves", is hereby amended by excising the portion being

the portion commencing at the south-eastern corner of the reserve and extending westward along the northern alignment of Stirling Street for a distance of seventy-five links, thence north to the high-water mark of Leschenault Inlet, thence south-easterly along that high-water mark to the eastern boundary of the reserve and thence south along that boundary to the starting point.

(2) The portion so excised shall be reserved for the purpose of a "Boat Shed Site", for the Fisheries Department.

The purpose of Reserve No. 6962 is hereby altered from "Harbour and River Wharves" to "Park Lands and Recreation", with the intention that the reserve be vested in the Town of Bunbury, in trust, for those purposes.

4. Reserve No. 8606, at Busselton, classified as of Class "A" and set apart for the purpose of "Recrea- tion", is hereby reduced by the excision of portion comprising an area of seven and two-tenths perches that has been included by survey in Busselton Lot 343, with the intention that it be included in the adjoining Reserve No. 25637 that is set apart for the purpose of "Tea Rooms Site" and is vested in the Shire of Busselton.

5. Reserve No. 9719, at Busselton, classified as of Class "A" and set apart for the purpose of "Recrea- tion", is hereby reduced by the excision of portion comprising an area of one rood twelve and five- tenths perches that has been included by survey in Busselton Lot 343, with the intention that it be included in the adjoining Reserve No. 25637 that is set apart for the purpose of "Tea Rooms Site" and is vested in the Shire of Busselton.

6. (1) Reserve No. 1668, at Dalkeith, classified Nos 1668 as of Class "A" and set apart for the purpose of Dalkeith. "Recreation" and vested in the City of Nedlands,

in trust, for that purpose, under the provisions of section thirty-three of the Land Act, 1933, is hereby reduced by the excision of all that portion of Melville Suburban Area Lot 34 containing an area of one rood and thirty-three and four-tenths perches, now surveyed as Swan Location 7218, as shown bordered red, together with a truncation at the north-western corner of the location as shown coloured brown, on Lands and Surveys Diagram No. 68605.

(2) The land comprised in the portion so excised is hereby revested in Her Majesty, as of Her former estate, with the intention that Swan Location 7218 be reserved for the purpose of a "Kindergarten Site" to be vested in the City of Nedlands, in trust, for that purpose, with power to lease the proposed reserve to the Dalkeith Kindergarten Incorporated.

(3) The truncation referred to in subsection (1) of this section is hereby dedicated as a widening of the intersection of Victoria Avenue and Beatrice Road.

9. Reserve No. 22798, at Kalamunda, classified

as of Class "A" and set apart for the "Conservation of Native Flora", is hereby cancelled, with the intention that the land be included in a proposed reserve for the purpose of a "Swimming Pool".

No. 23989 10. (1) Reserve No. 23989, comprising Swan

Melville. Location 5529, containing twelve acres two roods

nine perches, at Melville, classified as of Class "A" and set apart for the purpose of "Recreation" and vested in the Town of Melville, is hereby cancelled.

The land comprised in the reserve by this section cancelled is hereby revested in Her Majesty, as of Her former estate, with the intention that it be included in the adjoining Melville Schoolsite Reserve, No. 24211.

(3) An equivalent area of land in the locality of the cancelled reserve shall be set apart as a reserve for "Recreation" and shall be classified as of Class "A" and be vested in the Town of Melville, in trust, for that purpose.

(1) Reserve No. 3660, comprising Avon Location 2295, at Moombekine and set apart for the purpose of an "Agricultural Hallsite", is hereby cancelled.

(2) Avon Location 2295, as comprised in Certifi- cate of Title Volume 170 Folio 110 registered in the names of Thomas Brooks, Henry Wilkins, George Parnham and William Harding Butterly, as Trustees of the Moombekine Agricultural Hall, is hereby revested in Her Majesty, as of Her former estate, and is hereby removed from the operation of the Transfer of Land Act, 1893, with the intention that it be reserved for another purpose under the provisions of the Land Act, 1933, in such manner as the Governor may approve.

Education Endowment, in Crown Grant Volume 556 Folio 26, is hereby reduced by the excision of Narrogin Lot 711 containing three acres one rood twenty-seven perches.

(2) The Trustees of the Public Education Endow-

ment are hereby authorised to dispose of Narrogin

Lot 711 and to transfer the land, free of any trust.

13.    (1) Reserve No. 19673, near Redmond, W18613

classified as of Class "A" and set apart for the Redmond.

(2) The land comprised in the portion so excised shall be reserved for "Municipal Requirements (Gravel and Sand)", in such manner as the Governor may approve.

14.    (1) Reserve No. 25373, at Scott River, classified ts.2511373

as of Class "A" and set apart for the purposes of Scott River.

by the excision of all that portion being

the portion comprising one hundred and ninety-five acres or thereabouts lying directly between the northern boundaries of Sussex Locations 2977, 2978, 2979 and 2980 and forty feet from the high-water mark of the Scott River and being the portion referred to in subparagraph (ii) of paragraph (a) of sub- clause (1) of clause ten of the Schedule of the Iron Ore (Scott River) Agreement Act, 1961.

(2) The land so excised from the Reserve shall be included in a "Works Site", in accordance with the provisions of the Iron Ore (Scott River) Agreement Act, 1961.

(1) Reserve No. 9299, at Swanbourne, in the Municipal District of the City of Nedlands, classified as of Class "A" and set apart for the purpose of an Education Endowment, is hereby reduced by the excision of the portion being

all that portion of Cottesloe Lot 162 bounded on the north by Alfred Road, on the east and south by Narla Road and on the west by Servetus Street, being portion of the land comprised in Certificate of Title Volume 815 Folio 144, registered in the name of Trustees of the Public Education Endowment.

(2) The land comprised in the portion excised by the operation of subsection (1) of this section is hereby revested in Her Majesty, as of Her former estate, and is removed from the operation of the Transfer of Land Act, 1893, with the intention that, after provision of necessary road widenings, the land be reserved for the purpose of the "Swanbourne High School site".

(1) Reserve No. 24522, near Thirsty Point, in the Melbourne District, classified as of Class "A" and set apart for the purposes of "Preservation of Caves and National Park", is hereby reduced in area by the excision of

all that portion commencing at a point on the south boundary of the reserve situated fifty chains west of the western boundary of Mel- bourne Location 2489 and extending north to the northern boundary of the reserve, thence west along that boundary to the high-water mark of the Indian Ocean, thence generally southward along that high-water mark to the south-western corner of the reserve and thence east to the starting point.

(2) The land comprised in the portion so excised may be reserved for townsite purposes, in such manner as the Governor may approve.
