AN ACT relating to certain Reserves and

other Lands.

[Assented to 4th January, 1957.]

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:-

Short title.

1.    This Act may be cited as the Reserves Act,

Reserve No. 13012 classified as of Class "A" and set apart for the purposes of Botanical Gardens, Park and Recreation and vested in the City of Perth in trust for such purposes is hereby reduced by the excision of Perth Lot 478, with the intention that the portion so excised shall be set apart as a separate reserve for the purposes of a Vehicle Park and Gardens, classified as of Class "A" and be vested in the City of Perth in trust for those purposes.

Reserve

Reserve No. 23123 (Perth Lot 757) classified as of Class "A" and set apart for the purposes of Beautification, Recreation and Temporary Car Parking and vested in the City of Perth by virtue of section two of Act No. 38 of 1950 is by force of this Act set apart for the purposes of Vehicle Park and Gardens and is vested in the City of Perth in trust for those purposes.

Reserve No.

(1) Reserve No. 23124 (Perth Lot 758) classi- fied as of Class "A" and vested in the National Parks Board of Western Australia in trust for the purposes of Recreation and Beautification is by force of this Act set apart for the purposes of Vehicle Park and Gardens and is vested in the City of Perth in trust for those purposes, subject, however, to any rights of the Commonwealth or rights under the laws of the Commonwealth in respect of the land comprised within the reserve.

(2) This section shall come into operation upon a date to be fixed by proclamation.

Reserve

The Governor is hereby authorised to grant to the Municipality of Claremont an estate in fee simple in the portion of Reserve No. 8002 (Swan Location 1798) to be surveyed as Swan Location 6156 free of any trust, and the Municipality shall have power to subdivide and sell the land subject however, to the provision that the net proceeds of any sale of the land shall be used in the development of the balance of Reserve No. 8002 so remaining.
