AN ACT relating to certain Reserves.

[Assented to 7th January, 1952.]

RE it enacted by the King's Most Excellent

Majesty, by and with the advice and consent

of the Legislative Council and the Legislative

Assembly of Western Australia, in this present

Parliament assembled, and by the authority of the

same, as follows:-

Short title.

1.

This Act may be cited as the Reserves Act,

1951.

Certain land

All that portion of Plantagenet Location 44 containing an area of 16 perches, having a frontage to Seymour Street, Albany, and being the sole remaining land comprised in Certificate of Title, Volume 13, Folio 377, and registered in the name of Joseph Spencer, of Balgarrup, who died on the first day of June 1891, is hereby revested in His Majesty as of his former estate, with the intention that the land shall be reserved as a Memorial to Sir Richard and Lady Spencer, the parents of the deceased regis- tered proprietor, who were pioneers of Albany and whose remains are buried in the land.

ninety-nine years and now the subject of Lease 543/42 registered in the names of Joseph Anthony Elliott, Frederick Turner and Thomas Henry Peter- son as trustees of the Cuballing Agricultural Hall, is revested in His Majesty as of his former estate, with the intention that it shall be again reserved for the purpose of an Agricultural Hall and vested in the Cuballing Road Board.

(2) Reserve No. 2562 is still further reduced by the excision of all land between Marine Terrace and the roadway known as Willcock Drive (which is surveyed as shown on Lands and Surveys Original Plan No. 5911) and also by the excision of that land between the southern boundary of Reserve No. 2563 and the roadway known as Willcock Drive, with the intention that the land so excised shall he dealt with pursuant to the provisions of the Land Act, 1933, in such manner as the Governor may. decide.

Reserve No. 12076, classified as of Class "A" and set apart for the purpose of an Education Endowment and vested for an estate in fee simple in the Trustees of the Public Education Endowment in Certificate of Title, Volume 1068, Folio 713, is hereby reduced by the excision of Katanning Lots 505 to 509, inclusive, which the Trustees of the Public Education Endowment are hereby authorised to sell to the Katanning Road Board freed and dis- charged of all trusts.

Notwithstanding section two of Act No. 38 of 1941, Perth Lot 0 18 held in trust by the Mayor and Councillors of Perth for Municipal purposes solely is hereby freed of all trusts with the intent that the City of Perth is permitted to sell the eastern portion of the lot containing 1 rood 2.04 perches or there- abouts and transfer the western portion containing 1 rood 22.96 perches or thereabouts to His Majesty the King.

(3) The portions of the reserve specified in the Items set out at the foot of this subsection are hereby excised from the reserve so as to be available for the acquisition by the Commonwealth for Defence Purposes.

(4) The Commonwealth having for Defence Pur- poses acquired over portions of the reserve the easements mentioned in the Items set out at the foot of this subsection, those portions are hereby declared to be subject to those easements.

Item 1—All that portion of land required for drainage purposes appurtenant to Swan Location 4296 and being a strip of land 20 links wide, the southern side of which starts at the westernmost corner of Swan Location 4296 and extends 243 degrees 16 minutes 1 chain 76 links; thence 279 degrees 17 minutes 3 chains 78 and 5/10ths links, and thence 278 degrees 4 minutes 2 chains, as shown on Lands and Surveys Diagram 44327.

Item 2—All that portion of land required for a pipe line and being appurtenant to Swan Location 3110, as numbered 6 and coloured blue on Lands and Surveys Plan Miscel- laneous 91.

Item 3—All those portions of land required for Tramway and Jetty purposes and being appurtenant to Swan Locations 3751 and 3752, as numbered 15 and 16, respectively, and coloured green on Lands and Surveys Plan Miscellaneous 91.

Item 4—All that portion of land required for a pipe line and being appurtenant to Swan Location 5119, as numbered 12, 13 and 14 and coloured red on Lands and Surveys Plan Miscellaneous 91.

Reserve No. 12084, classified as of Class "A" and set apart for the purpose of a Public Education Endowment, is hereby reduced by the excision of Tammin Lot 61, containing 3 acres 2 roods and 39 perches, as comprised in Certificate of Title, Volume 559, Folio 101, and the Trustees of the Public Education Endowment are hereby authorised to dispose of the land comprised in that lot freed and discharged of all trusts.
