AN ACT relating to certain reserves.

[Assented to 7th January, 1949.]

BE it enacted by the King's Most Excellent Majesty,by and with the advice and consent of the Legis- lative Council and Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

1. This Act may be cited as the Reserves Act, 1948,

Brown Hill Suburban Area Lot 207, being Reserve No. 8625, granted for an estate in leasehold, for a term of nine hundred and ninety-nine years and now the subject of Lease No. 401/42, registered in the names of Jabez Edward Dodd, Thomas James Alford and Charles Cressy, in trust as a site for a Mechanics' Institute, is hereby revested in His Majesty as of his former estate to the intent that it shall be again reserved for the purposes of a hall site and vested in the Minister for Works.

Portion of Meckering Lot 358, being Lots 4, 5 and 6 on Land Titles Office Diagram 3038, the subject of Certificate of Title, Volume 465, Folio 167, and now registered in the names of Charles Samuel Rhodes and Robert Balmain Blyth as Trustees of the Meckering Hall, is hereby revested in His Majesty as of his former estate to the intent that it shall be reserved for the purpose of a Road Board Depot and vested in the Cunderdin Road Board.

(1) The purposes of

The Governor may grant the fee simple of the lands comprised in those reserves, to the Moora Road Board, in trust, for the purpose of endowment aforesaid.

The Board is hereby authorised to sell those lands by a method of free and open public competition and transfer them to the purchaser subject to the approval of the Governor to be endorsed on the instrument of transfer, and upon registration of transfer the relevant land shall be freed and discharged from any trust, condition, limitation or other restriction imposed in relation to the purpose of the reserves.

(4) The Board shall apply the proceeds from the sale to the payment of costs in or about the acquisition of land for a recreation ground adjacent to the townsite of Miling and for no other purpose.

(2) The land which has been excised from Reserve No. 2021 by the operation of the last preceding subsection may be disposed of by the Governor for an estate in fee simple by direct sale to Stewarts and Lloyds (Aus- tralia) Proprietary Limited for the purchase price of six hundred and ten pounds, and upon payment of that purchase price, and the prescribed Crown Grant fee, the Crown Grant may issue accordingly.
