AN ACT relating to certain reserves and other lands.

[Assented to lath January, 1948.]

BE it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis- lative Council and Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

1.    This Act may be cited as the Reserves Act, 1947. Short title.

Esperance Location 373, being Reserve No. 3330,

granted to William Farmer, Edward James McCarthy

and John Moore Dickson, as trustees for the Esperance Bay Turf Club, is hereby revested in I-Es Majesty as of his former estate and may be dealt with under the

provisions of the Land Act, 1933-1946, as the Governor

may think fit.

Morawa Lot 68, being portion of Reserve No. Reserve

No. 18120.

18120, granted to the Morawa Road Board for an estate

in fee simple for "Hall Site and Local Government Purposes," and being portion of the land registered in

Volume 1063, Folio 5, is hereby revested in His Majesty

as of his former estate to the intent that the same may be disposed of by the Governor by direct sale to the Commissioners of the Rural and Industries Bank of Western Australia for an estate in fee simple at the purchase price of one hundred pounds, and upon pay- ment of such purchase price, together with a Crown Grant fee of thirty shillings, the Crown Grant may issue accordingly.

The purpose of Reserve No. 15174, comprising Carnarvon Lot 234, held by the Carnarvon Municipal Council for an estate in fee simple and registered in Volume 583, Folio 25, is hereby changed from "Library and Reading Room" to "Municipal Purposes," and upon this Act coming into force the Registrar of Titles shall amend the Register accordingly.

Reserve No. 6618 in the Gingin Townsite, classi- fied as of Class A and vested in the Gingin Road Board, is hereby cancelled, and the land may be dealt with under the Land Act, 1933-1946, as the Governor may think fit.

4813, classified as of Class A, situate at Point Walter,

that is to say:

All that portion of land bounded by lines starting from a point on the western side of Stock Road, and situate 16 chains 95 links northerly from the north- eastern corner of Swan Location 69, and extending 299 degrees 28 minutes 19 chains ; thence 30 degrees 15 minutes 11 chains ; thence 119 degrees 28 minutes 12 chains 50 links to the said side of Stock Road; and thence 179 degrees 28 minutes 12 chains 70 links to the starting point.

Bearings are true or thereabouts, and measure-

ments more or less. Area 17 acres 1 rood 12 perches;

may, for a period of ten years, which shall be deemed to

have commenced on the twenty-eighth day of March,

1947, be used for the purpose of an Immigrants' Home.

Narrogin

(1) Narrogin Lot 335, in the Narrogin Municipal District, granted in trust for an estate in leasehold for a term of nine hundred and ninety-nine years for a site for a church to John Hermon Shilling, Moses Lindsay Read, Ernest John Butler, Edward Peace Illingworth, Moses Herbert Mowday, John Clark Chinas, Victor Doney, and Robert John Lennard Ewing, as trustees under "The Methodist Church Model Deed of Western Australia, 1912," is hereby revested in His Majesty as of his former estate.

(2) Narrogin Lot 160, in the Narrogin Municipal District, granted for an estate in fee simple to the Nar- rogin Municipality upon trust for the purpose of muni- cipal endowment, is hereby revested in I-Iis Majesty as of his former estate.

Narrogin Lot 335, which is revested by the opera- tion of subsection (1) of this section, may be granted for an estate in fee simple to the Narrogin Municipality upon trust for the purpose of a municipal endowment, in lieu of Narrogin Lot 160 aforesaid.

Narrogin Lot 160, which is revested by the opera- tion of subsection (2) of this section, may be granted for an estate in leasehold for a term of nine hundred and ninety-nine years to trustees under "The Methodist Church Model Deed of Western Australia, 1912," upon trust for the purpose of a site for a church, in lieu of Narrogin Lot 335 aforesaid.

granted for an estate in leasehold for a term of ninety- nine years, and now registered in the name of Thomas Richard Smith in trust as a site for a hall, is hereby revested in His Majesty as of his former estate to the intent that the same shall be again reserved for the purpose of a hall site and vested in the Mundaring Road Board.

Street, situate 1 chain northerly from the north-eastern corner of Lot 3 of Melbourne Location 908, as shown on Land Titles Office Plan 2838, and extending northerly along the said alignment, 2 chains 99 9/10th links; thence westerly, at right angles to same, 3 chains 50 3/10th links, to a point situate in prolongation northerly of the western alignment of Findlater Street; thence southerly, 3 chains, along the said prolongation; and thence east- erly, 3 chains 50 3/10th links, to the starting point; area

1 acre 0 roods 8 1/10th perches, which said piece of land forms portion of an area of land contracted to be granted in fee simple pursuant to the provisions of a certain Agreement made the twenty-seventh day of February, one thousand eight hundred and eighty-six, between Sir Frederick Napier Broome, acting for and on behalf of the Government of the Colony of Western Australia, of the one part, and John Waddington, by his attorney, Richard Price-Williams, of the other part, is hereby revested in His Majesty as of his former estate to the intent that the same shall be set apart under the provisions of the Land Act, 1933-1946, as a reserve for a Fallen Soldiers' Memorial Site, and classified A Class, and shall be granted to the Moora Road Board for an estate in fee simple in trust for the purpose aforesaid.

All that portion of Class A Recreation Reserve No. 21487, at Rockingham, containing an area of two perches, that is to say

All that portion of lot 408, Rockingham Reserve A21487, bounded by lines starting at the southern- most corner of the said lot and extending 319 degrees 54 minutes 34 9/10th links ; thence 95 degrees 56 minutes 1 chain 4 9/10th links to the northern side of the Esplanade ; and thence 259 degrees 1 minute 83 4/10th links along the said side to the starting point ;

is hereby excised from the said reserve and is added to the abutting road known as Esplanade, for the purpose of increasing the width of a narrow section of same to one chain.

Those pieces of land being portion of Class A Reserve No. 13012 for the purpose of botanical gardens park and recreation, and being Perth Lots 478, 639 and 640 are hereby, for a period of five years commencing from the first day of January, 1948, removed from the operation of the said reservation with the intention that the said pieces of land may be set aside under the pro- visions of the Land Act, 1933-1946, as a reserve for the purpose of a car parking area and classified as of Class A.
