AN ACT relating to certain reserves and other lands.

[Assented to 30th January, 1946.]

BE it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis- lative Council and Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows :—

1. This Act may be cited as the Reserves Act, 1945.

2. All that piece of land now comprised in reserve A19574 and vested in the Nedlands Road Board for the purpose of recreation (children's playground) is hereby revested in His Majesty the King as of his former estate with the intent that it he set apart for the purpose of a site for the erection of veterinary laboratories.

All that reserve 2665 (Wellington Location 1212) held under a ninety-nine years' lease registered in Certi- ficate of Leasehold Title Volume 207, Folio 54 by John Trigwell of Preston, Farmer, Hugh Spicer Brockman of Donnybrook, Gentleman, and Valentine Campfield Mitchell of Donnybrook, Farmer, solely for the purposes of the Preston Race Club is hereby revested in His Majesty the King as of his former estate and may be dealt with as Crown Land under the provisions of the Land Act, 1933-1939.

the estate and interest of the said South Perth Road Board therein may be surrendered by the South Perth Road Board to His Majesty the King.

(2) The said land, when so surrendered, shall vest in His Majesty as of his former estate with the intent that, upon such surrender, the said land shall be reserved under the provisions of the Land Act, 1933-1939, as a site for a hall and other necessary buildings for the use of members of The Returned Sailors, Soldiers and Air- men's Imperial League of Australia (W.A. Branch) Incorporated and thereafter may be granted in fee simple for such purposes under the said Act to the said cor- poration.

The purposes of reserve A8313 at Northam are hereby changed from "recreation" to a "native reserve."

Upon the passing of this Act, the Permanent Reserve (Point Walter) Act, 1921, shall cease to have effect.

All that portion of Reserve A11379 for education endowment at Collie, which is comprised in Collie Lots 881 to 896 both inclusive, 907 to 914 both inclusive, 917, 918, 919 and 922 granted to the Trustees of the Public Education Endowment, is hereby excised from the said reserve to the intent that the land comprised in the said lots may be sold and disposed of and transferred as for an estate in fee simple by the said Trustees of the Public Education Endowment freed and discharged of all trusts.

All that reserve 17473 for education endowment at Merredin, comprising Merredin Lots 466, 467, 468, 473, 474 and 475 granted to the Trustees of the Public Educa- tion Endowment is hereby cancelled and the said Trustees of the Public Education Endowment are hereby em- powered to sell and dispose of and transfer as for an estate in fee simple the land comprised in the said lots freed and discharged from all trusts.

Lot 1517.

10. All that piece of land being part of Fremantle Lot 1517 the subject of Lands Titles Office diagram 12882 being portion of the land comprised in Certificate of Title Volume 304, Folio 26, granted to the Mayor and Councillors of the Municipality of Fremantle upon trust solely for the purposes of a public park is hereby excised from the said grant and may be surrendered by the Mayor and Councillors of the Municipality of Fremantle to the Crown freed and discharged from the said trust, to the intent that the said land may be set aside under the pro- visions of the Land Act, 1933-1939, as a reserve for educa- tional purposes.

11. (1) All that reserve A21511 for public recreation

vested in the City of Fremantle is hereby revested in His Majesty the King as of his former estate to the intent that the land, when revested as aforesaid may be set aside under the provisions of the Land Act, 1933-1939, as a reserve for educational purposes.

(2) Such provisions of the Fremantle (Skinner street) Disused Cemetery Act, 1909, the Fremantle (Skinner street) Disused Cemetery Amendment Act, 1931, and the Fremantle (Skinner street) Disused Cemetery Amend- ment Act, 1935 as are inconsistent with or repugnant to this Act, shall as from the date of the passing of this Act, cease to have effect.
