No. 37 of 1944.

AN ACT relating to certain reserves and other lands.

[Assented to 23rd December, 1944.]

BE it enacted by the King's Most Excellent Majesty,by and with the advice and consent of the Legis- lative Council and Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows :—

Short title.	1.	This Act may be cited as the Reserves Act, 1944.

A 14803.	2.

All those pieces of land now included in Reserve A 14803 for park lands and recreation at Merredin more particularly described in the Schedule to this Act are hereby excised from the said reserve with intent that subject to the provisions of the Land Act, 1933-1939, they may together with other lands be leased to the Com- monwealth of Australia.

The Nedlands Road Board in which is vested Reserve A 7804 for park and recreation is hereby auth- orised during the period of twenty-one years computed from the date of the commencement of this section to grant to any persons for residential purposes leases or tenancies of the three dwelling houses erected and stand- ing on that piece of land being Cottesloe Lot 199 which

is included in the said Reserve provided that no such lease or tenancy shall be granted for a term which shall expire after the said period of twenty-one years.

The Serpentinejarralidale Road Board in which is vested by virtue of a grant in fee simple registered ill Certificate of Title Volume 1047, Folio 553, Reserve 19134 (Cockburn Sound Location 778) for recreation, racecourse and show ground is hereby authorised to grant to Whittaker Bros., Limited, for the purposes of a sawmill site a lease of any portion of the said reserve not exceeding in area six acres for a term not exceeding ten years provided that any such lease shall have no force or effect unless and until it is approved by the Governor.

cillors and burgesses of Northam in trust for use as a site for a Town Hall shall hereafter be held by the said grantees in trust for recreation purposes, and the pur- poses for which the said land may be held are hereby changed accordingly.

All that Reserve 2166 (Serpentine Agricultural Area Lot 94) held under a ninety-nine years' lease registered in Certificate of Leasehold Title Volume 182, Folio 180, by Frederick Robinson, Antonio Szezecinski, Frederick William Rudd, Andrew Armstrong, Arthur De Banks, Richard Green, and Donald Paterson as trus- tees for the Mundijong Race Course is hereby revested in His Majesty the King as of his former estate and may be dealt with as Crown Land under the provisions of the Land Act, 1933-1939.

All that Reserve 567 (Bunbury Town Lots 155 and 156) for recreation, and all that Reserve 19299 (Bunbmy	667 and

Town Lot 174) for recreation heretofore and at present occupied by or vested in the Bunbury Municipal Council and used by the said Council as a site for a municipal depot are hereby revested in His Majesty the King as of his former estate with the intent that the lands com- prised in the said reserves may be granted in fee simple to the said Bunbury Municipal Council free of any trust

with power to the said Council to sell the same and re- tain as ordinary revenue the proceeds derived from such sale.

All that portion of Reserve A 14803 being Merredin Town Lot 522 bounded by lines commencing at a point situate 1 chain 10 links south from the westernmost south-west corner of Merredin Town Lot 332 and extending 89 degrees 59 minutes 11 chains 10 5/10 links, 180 degrees 1 minute 5 chains 25 links, 269 degrees 59 minutes 11 chains 10 3/10 links, and thence 0 degrees 0 minutes 5 chains 25 links to the starting point.

PART 2.

All that portion of Reserve A 14803 being Merredin Town Lot 523 bounded by lines commencing at a point situate 1 chain 10 links south from the westernmost south-west corner of Merredin Town Lot 343 and extending 90 degrees 0 minutes 18 chains 60 links, 180 degrees 0 minutes 5 chains 25 links, 270 degrees 0 minutes 18 chains 60 links, and thence 0 degrees 0 minutes 5 chains 25 links to the starting point.

PART 3.

All that portion of Reserve A 14803 being portion of Merredin Town Lot 524 bounded by lines commencing at a point situate 1 chain 10 links west from the southernmost south-west corner of Merredin Town Lot 280 and extending 270 degrees 1 minute 6 chains 9 7/10 links, 0 degrees 0 minutes 11 chains 49 3/10 links, 90 degrees 1 minute 6 chains 10 links, and thence 180 degrees 1 minute 11 chains 49 3/10 links to the starting point.

Bearings are true or thereabouts and the measurements more or

less.
