No. 24 of 1926.
AN ACT to change the purpose of, and otherwise relating
to, certain Reserves.
[Assented to 19th November, 1926.]

in the present Parliament assembled, and by the authority
of the same, as follows :-

Reserve *17084 (Perenjori Lot 43), vested in trustees for an agricultural hall site, may be sold by the trustees as the registered proprietors thereof, and transferred to a purchaser freed and discharged from any trust, but subject to the existing mortgage No. 3997/19 in favour of the Western Australian Bank : Provided that the proceeds of sale shall be applied by the trustees to the erection of an agricultural hall on another site to be ap- proved by the Minister for Lands.

Yealering Lot 27, reserved and vested in trustees for an agricultural hall site, may be granted to the trustees for an estate in fee simple, and the trustees are hereby authorised to sell the said land and transfer the same to the purchaser freed and discharged from any trust : Pro- vided that the proceeds of sale shall be applied towards the improvement of Reserve £19201 as an agricultural hall site.

| Crown Lease No. 525/19 of Kuhn Lot 15, may be surrendered to the Crown by the surviving lessees ; and thereupon the Governor may grant to the Roe Road Board Kulin Lots 14, 15, 35, and 36 for an estate in fee simple, with power to sell the land and transfer the same to a purchaser freed and discharged from any trust : Provided that the proceeds of sale shall be applied by the Roe Road Board to the purchase of Kulin Lots 85 and so, or other suitable land, and the erection thereon of an agricultural hall and road board offices. | Kolb/ Lot 15, etc. |

| Dumbleyung, Reserve *17534 (Dumbleyung Lot 244), containing 16 acres 1 rood 26 perches, and Reserve *15215 (Dumbleyung Lot 216), containing about 125 acres, for an estate in fee simple, with power to sell and transfer the same to a purchaser, subject to the proceeds of sale being applied by the said Board to the purchase and improve- ment of Williams Location 5544, or other suitable land to be acquired by the said Board, for the purposes of a sports and show ground. |

tered proprietors of Cue Town Lot 14, may surrender the grant, and thereupon the Governor may grant the said land in fee Simple to the Cue-Day Dawn Road Board for the purpose of a miners' institute.
7. The Fremantle and District Trades Hall Industrial Fremantle Town
Association of Workers may sell Fremantle Town Lots Lots 1511 and mu.
1511 and 1512, and transfer the same to the purchaser freed and discharged from any trust. The proceeds of sale shall be applied to the erection of a hall for the pur- poses of the said association on Fremantle Town Lot 380, or other land to be approved by the Minister for Lands.
8. (1) The Victoria District Agricultural Society In- ntoorla Location
corporated may, with the consent of the Governor, mortgage Victoria Location 5950, being the land comprised in Crown Lease 1894/1923 and held by the said society.
(2) The land so mortgaged shall, on the exercise by the mortgagee of the power of sale or on foreclosure, vest in the purchaser or in the mortgagee, as the case may be, freed and discharged from any trust or restrictions to which the land may, for the time being, be subject.

Manjimup Lot 6, reserved for a road board office site, may be granted to the Manjimup Road Board for an estate in fee simple, and the said Board may sell the said land and transfer the same to a purchaser freed and dis- charged from any trust : Provided that the proceeds shall be applied to the improvement of Manjimup Lots 140 and 141, reserved and set apart for a road board office and hall site. |
| Reserve A*569. | 10. An area of two acres may be excised from Reserve A *569 (public recreation) at Waddington, for the pur- pose of a public hall site. |
| Reserve A4.5690. | 11. Perth Town Lot 636 at Subiaco, containing 1 rood 17 perches, may be excised from Reserve A *5690 (police) and included in Reserve A *5183 (recreation) and vested in the Subiaco Municipality. |
Lae Grace Lot 116. 12. The Commissioners of the Presbyterian Church of
Western Australia may surrender their lease of Lake Grace Lot 116, and the Governor may grant to the said Com- missioners a lease of Lake Grace Lot 117 in lieu thereof for the term of ninety-nine years, for the purposes of a public hospital.

| etc. | 13. (1) That portion of Reserve A /0574 described in Part I. of the schedule hereto is hereby excised therefrom. |
| (2) Reserve *8722 (municipal purposes) and Reserve *10750 (caretaker's quarters, zoological gardens), are hereby cancelled. | |
| (3) So much of the said Reserves A *5574, *8722, and *10750, as is described in Part 11. of the schedule, may be declared a reserve as of Class A for a parking ground for vehicles. | |
| (4) The remainder of the said Reserves *8722 and 410750 is hereby added to Reserve A *5574 ; and the purpose of that reserve is hereby changed from botanical gardens to public recreation. | |
| Provided that the trees and natural growth on those portions of such reserve, which are described in Part of the said schedule, shall not be removed or destroyed, and that those portions of the said reserve shall not be used for any purpose -which is likely to lead to the removal or destruction of any of such trees or growth. |

Lot 431 and extending 339° 52' 4 chains 9 . 6 links along said side to the tangent point of a circular curve, the bearing and length of whose radius aro 249° 52' and 50 links respectively ; thence North-Westerly 78 . 5 links along said curve ; thence 249° 52' 86 . 4 links ; thence 159° 52' 5 chains 9 . 6 links to the North-Western side of Amherst Street ; thence 69° 52' 86.4 links along said side to the tangent point of another circular curve the bearing and length of whose radius aro 339° 52' and 50 links respectively ; and thence North-Easterly 78 . 5 links along the last mentioned curve to the starting point.

of the portion of Reserve 8722, set apart as a parking reserve, and that portion of Reserve 5574, ono chain wide, abutting on Amherst Street, which extends from
Melville Terrace to the South-West boundary of the portion of Reserve 5574, set
apart as a parking reserve.
