RESERVE (NO. 1720) ACT 1994

No. 65 of 1994

AN ACT to excise a portion of Reserve No. 1720 (Rings Park) and to facilitate the sale and development of the excised area.

The Parliament of Western Australia enacts as follows:

Reserve (No. 1720) Act 1994

Short title

1.     This Act may be cited as the Reserve (No. 1720) Act 1994.

Commencement

2.    This Act comes into operation on the day on which it

receives the Royal Assent.

Reserve No. 1720, Rings Park, Perth

3.     (1) Reserve No. 1720, Kings Park, Perth, classified as of

Class A, containing 400.809 0 hectares, set apart for "Public

Park" is amended by excising

(a)

4 square metres being Perth Lot 1058 as shown bordered green; and

(b)

2391 square metres being Perth Lot 1059 as shown bordered green,

on Diagram No. 91493 held by the Graphic Bank within the Department of Land Administration, so that the reserve contains 400.569 5 hectares.

(2)

The land excised from Reserve No. 1720 by subsection

(1) (a) and (1) (b) is, by this subsection, constituted Crown land

within the meaning of that expression in the Land Act 1933.

(3)

Despite —

(a)

the Metropolitan Region Town Planning Scheme Act 1959 and the Metropolitan Region Scheme made under that Act; and

(b)

the Town Planning and Development Act 1928 and the City of Perth City Planning Scheme made under that Act,

and subject to subsection (4), Perth Lots 1058 and 1059, as shown bordered green on Diagram No. 91493, are by this

Reserve (No. 1720) Act 1994

subsection classified as "R Code Density R160" under the City of

Perth City Planning Scheme.

(4) By this subsection, Perth Lot 1059 —

(a)

is to be developed in accordance with the provisions of the City of Perth City Planning Scheme;

(b)

is, for the purposes of any development under paragraph (a), to be treated as if it were an area of

4550 square metres; and

(c)

is not subject to the requirements of clause 66 (2) of the City of Perth City Planning Scheme.

(5) In this section —

"the City of Perth City Planning Scheme" means the City of Perth City Planning Scheme as amended from time to time.
