1  Name

This instrument is the Resale Royalty Right for Visual Artists (Format of Notice of Commercial Resale) Determination 2023.

2  Commencement

(1)  Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

This instrument is made under Regulation 7 of the Resale Royalty Right for Visual Artists Regulations 2021.

4  Definitions

In this instrument:

Act means the Resale Royalty Right for Visual Artists Act 2009.

5  Schedule 3

Each instrument that is specified in Schedule 3 to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in that Schedule has effect according to its terms.

6  Formats of Notice of commercial resale

(1)For the purposes of section 28 of the Act, each of the following is a format of notice of commercial resale:

(a)an interactive web form, in the format set out in Schedule 1 to this Instrument provided at the internet address: and

(b)an excel spreadsheet, in the format set out in Schedule 2 to this Instrument, provided at the internet address: 1—Format (Interactive Web Form)
