FRENCH CJ:   This appeal from the Full Court of the Federal Court of Australia was heard in Canberra on 29 and 30 March 2010 by a Court constituted by Justices Gummow, Hayne, Heydon, Crennan, Kiefel, Bell and myself. 

On 30 March the Court pronounced orders allowing the appeal and confirming the orders of the magistrate.

I now publish my reasons for joining in those orders.
