Repeal of Regulations Postponement Act (No. 2) 2010

An Act to postpone the repeal of certain regulations

[Royal Assent 14 December 2010]

Be it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:

1Short titleThis Act may be cited as the Repeal of Regulations Postponement Act (No. 2) 2010 . 2CommencementThis Act commences on the day on which this Act receives the Royal Assent. 3Postponement of repeals (1)  The staged repeals of the Agricultural and Veterinary Chemicals (Control of Use) Regulations 1996 and the Workplace Health and Safety Regulations 1998 that, but for this section, were to have been effected on 1 January 2011 are postponed until 1 January 2012. (2)  Subsection (1) does not prevent the Agricultural and Veterinary Chemicals (Control of Use) Regulations 1996 or the Workplace Health and Safety Regulations 1998 from being rescinded before 1 January 2012. (3)  In this section – staged repeal, in relation to – (a) the Agricultural and Veterinary Chemicals (Control of Use) Regulations 1996 , means the repeal that was to be effected by section 11 of the Subordinate Legislation Act 1992 but was postponed under the Repeal of Regulations Postponement Act 2006 , the Repeal of Regulations Postponement Act 2007 , the Repeal of Regulations Postponement Act 2008 and the Repeal of Regulations Postponement Act (No. 2) 2009 ; and (b) the Workplace Health and Safety Regulations 1998 , means the repeal that was to be effected by section 11 of the Subordinate Legislation Act 1992 but was postponed under the Repeal of Regulations Postponement Act 2008 and the Repeal of Regulations Postponement Act (No. 2) 2009 . 4Administration of ActUntil provision is made in relation to this Act by order under section 4 of the Administrative Arrangements Act 1990  – (a) the administration of this Act is assigned to the Minister for Primary Industries and Water; and (b) the department responsible to that Minister in relation to the administration of this Act is the Department of Primary Industries, Parks, Water and Environment. 5ExpiryThis Act expires on 2 January 2012.
