Pzddic Purptwes Loan Act of' 1867," and for other

purposes.

[Assented to, 26th June, 1872.1

HEREAS by

The Waste Lands Appropriation Act, 1862,"

W i t is, amongst other things, provided that two equal third

parts of the gross proceeds of the sale of the Waste Lands of the

Crown shall be appropriated as and for, and shall constitute, a fund to be called The Public Works Fund," and the remaining one- third part of the said gross proceeds shall be appropriated as and for, and shall constitutc, a separate ftmd to be called The Immi- gration Fund;" and it is also further provided that no money shall be at any time expended fiom either of the said funrls, except

in respect or on account of the public debt of the said Province,

without the sanction of an Act of the Parliament thcreof expressly directing or allowing such expenditure: -4nd whereas by Act No,

26 of 1867 certain payments out of the said funds theretofore made by the Treasurer were validated, although such payments had not

been made under the sanction of any Act expressly authorizing the same to be made out of either of the said funds: And whereas, since the passing of the said last-mentioned Act, various other pay- ments have been made out of the said fund, both on account of immigration and public works, as well as for public services, without the sanction of any Act expressly authorizing such last- mentioned payments out of either of the said f u d s as aforesaid: And whereas by the 'L Public Purposes Loan Act of 1867," power was given to the Treasurer fiom time to time to issue

bonds not exceeding in the whole the sum of Two Hundred and Twenty Thousand Pounds; and it was provided that all moneys raised and reccived by the Treasurer upon the security of the said bonds should be carried by him to the credit of the Gcnersl Revelme of thc said Province: Artd whereas prior to the passing of the last mentioned Act certain sums of money, forming portion of the said " I n m i p t i o n Fund" had been exiended on account of the general liabilities of the Government: And whereas the whole of the bonds authorized to be issued by the Treasurer under the snid " Publie Purposes IJoc~kl Act of l867 " were so issued by him and held by the Treasurer and Auditor-Gcneml on behalf of the said "Inimigration Fund," and as part security for repayment of the an~ouuts so expended by the Treasurer out of sucll f ~ ~ n d LZS aforesaid: And whcrcas the first threc of the said bonds of the value of Ten Thousaad Po~zncls each have since been redeemed by the Treasurer at maturity, and the interest on t2he whole issue has also been duly paid: Aud wlleretts it is expedient to repeal "The Waste Lauds Appropri- ation Act, 1862," aforesaid, and to declare the account on which rnoileys arising out of the proceeds of the sale of Waste Lands in the said Province have been since the first day of January, one thousand eight hundred and sixty-seven, and also to validate the appropriation tllercof; and further to repeal the said Public Purposes Loan Act of 1867," and to cancel the remainder of the bonds issued in pnrsumce thereof-Be it therefore Enacted by the Governor of tlie l'rovincc of South A~zstralia, mith tlle advicc and coilscnt of tlic Lesislative Council and IIousc of Assembly of the m

5. The bonds mentioned in the Schedule to this Act shall be Bondein Scbedulo

deemed to have been cancelled on the thirtieth day of December, ~ ~, " ~ f d ~ a n d

one thousand eight hundred and seventy-one, and shall be im- mediately burneb by the Treasurer in the pesknce of the Auditor- General; and thereupon the said Treasurer and Auditor-General shall cause a miuute thereof to be made upon a COPY of this Act, and such copy shall be kept amongst t h publie~ecords of the

said Province.
