Repatriation Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Repatriation Act 1920.

Commencement

1. Regulation 3 shall come into operation on 8 December 1983.

Severely incapacitated members

2. Regulation 104a of the Repatriation Regulations is amended —

(a) by omitting from sub-regulation (2) “$53” and substituting “$59”; and

(b) by omitting from sub-regulation (3) “$26.50” and substituting “$29.50”.

Funeral benefits—service pensioners

3. Regulation 179aof the Repatriation Regulations is amended by omitting sub-regulation (4) and substituting the following sub-regulation:

“(4) In paragraph (3) (b) ‘pensioner’ includes a person who has been granted a service pension—

(a) under section 85 of the Act as the wife of a member of the Forces; or

(b) under section 85aa of the Act.”.

Clothing allowance

4. Regulation 180a of the Repatriation Regulations is amended—

(a) by omitting from Column 2 of the table in sub-regulation (1) “4.00”, “1.90”, “2.60” and “2.60” and substituting “4.40”, “2.10”, “2.90” and “2.90” respectively;

(b) by omitting from sub-regulation (2) “$4” (wherever occurring) and substituting “$4.40”; and

(c) by omitting from sub-regulation (4) “$49.40” and substituting “$54.60”.

Application

5. (1) The amendments effected by regulation 2 apply in respect of instalments of allowance payable on or after 1 November 1983.

(2) The amendments effected by paragraphs 4 (a) and (b) apply in respect of instalments of allowance payable on or after 10 November 1983.

(3) The amendment effected by paragraph 4 (c) applies in respect of any amount payable on or after 10 November 1983.
