1Name

This instrument is the Renewable Energy (Electricity) Amendment (Solar Water Heater Eligibility) Regulations 2018.

    Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

This instrument is made under the Renewable Energy (Electricity) Act 2000.

Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1Solar water heaters

Renewable Energy (Electricity) Regulations 2001

After subregulation 3A(1)

Insert:

  1. (1A)

    However, a device is not a solar water heater if the number of certificates that could be created over a 10‑year period for the installation of the device in any one or more of the zones, worked out in accordance with the method mentioned in subregulation 19B(1) or 19BA(3), would be more than 2,500, unless the device was entered into the Register of solar water heaters before 1 December 2018.

At the end of regulation 19BB

Add:

  1. (3)

    The Regulator must not make a determination that would vary the information contained in the Register of solar water heaters in relation to a device entered into the Register before 1 December 2018, if the effect of the determination would be:

    1. (a)

      to increase, to more than 2,500 from a number less than or equal to 2,500, the number of certificates that could be created over a 10‑year period for the installation of the device in any one or more of the zones; or

    2. (b)

      to increase, from a number more than 2,500, the number of certificates that could be created over a 10‑year period for the installation of the device in any one or more of the zones.
