REGULATIONS UNDER THE REMUNERATION TRIBUNALS ACT 1973.*

I, THE ADMINISTRATOR of the Government of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Remuneration Tribunals Act 1973.

Amendments of the Remuneration Tribunals (Members’ Fees and Allowances) Regulations 

Commencement.

1. The amendments effected by these Regulations shall be deemed to have come into operation on 1 June 1976.

2. Regulation 3 of the Remuneration Tribunals (Members’ Fees and Allowances) Regulations is repealed and the following regulation substituted:—

Definitions.

“ 3. In these Regulations, unless the contrary intention appears—

‘ member’ means a member of the Remuneration Tribunal;

‘ the Act’ means the Remuneration Tribunals Act 1973.”.

Fees of member

3. Regulation 4 of the Remuneration Tribunals (Members’ Fees and Allowances) Regulations is amended by omitting the figures “ $6,000 ” and substituting the figures “ $7,000 ”.

Travelling allowance of members.

4. Regulation 5 of the Remuneration Tribunals (Members’ Fees and Allowances) Regulations is amended—

(a) by omitting sub-regulation (1) and substituting the following sub-regulation:—

“ (1) Subject to sub-regulation (2), where a member is, in the performance of his duties (including any duties under Part III of the Act), necessarily absent from the city or town in which he normally

resides or, where he does not normally reside in a city or town, the place at which he normally resides, he is entitled to be paid in respect of that absence such travelling allowance as would be payable to him in respect of that absence under and in accordance with the relevant determination of the Remuneration Tribunal if—

(a) he were an officer included in the First Division of the Australian Public Service and occupying the office of Secretary to the Department of Administrative Services; and

(b) that absence were an absence of such an officer from his headquarters.”; and

(b) by adding at the end thereof the following sub-regulation:—

“(3) For the purposes of sub-regulation (1), the relevant determination of the Remuneration Tribunal is Determination Number 1976/7 that, by virtue of sub-section 7 (5) of the Remuneration Tribunals Act 1973, is to be deemed to have come into operation on 1 June 1976.”.

Other allowances payable to members.

5. Regulation 6 of the Remuneration Tribunals (Members’ Fees and Allowances) Regulations is amended by omitting the words “ Department of the Special Minister of State ” and substituting the words “ Department of Administrative Services ”.

Allowances payable to members in respect of service outside Australia.

6. Regulation 7 of the Remuneration Tribunals (Members’ Fees and Allowances) Regulations is amended by omitting from sub-regulation (1) the words “ Department of the Special Minister of State ” and substituting the words “ Department of Administrative Services ”.

Fee of person appointed to assist Academic Salaries Tribunal.

7. Regulation 8 of the Remuneration Tribunals (Members’ Fees and Allowances) Regulations is amended by omitting the figures “ $60 ” and substituting the figures “ $70 ”.

Travelling allowance of person appointed to assist Academic Salaries Tribunal.

8. Regulation 9 of the Remuneration Tribunals (Members’ Fees and Allowances) Regulations is amended by omitting sub-regulation (1) and substituting the following sub-regulation:—

“ (1) Subject to sub-regulation (2), where a person appointed under subsection 12e (2) of the Act to assist the Academic Salaries Tribunal is, in the performance of his duties, necessarily absent from the city or town in which he normally resides or, where he does not normally reside in a city or town, the place at which he normally resides, he is entitled to he paid in respect of that absence such travelling allowance as would be payable to him in respect of that absence under sub-regulation 5 (1) if—

(a) he were a member; and

(b) that absence were an absence of a member, being an absence of the kind referred to in sub-regulation 5 (1).”.
