1  Name

This instrument is the Remuneration Tribunal (Judicial and Related Offices—Remuneration and Allowances) Amendment Determination 2018.

2  Commencement

(1)  Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3  Authority

This instrument is made under subsections 7(3), (3AA), (4) and (4B) of the Remuneration Tribunal Act 1973.

4  Schedules

Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1—Amendments

Remuneration Tribunal (Judicial and Related Offices—Remuneration and Allowances) Determination 2018

1  Section 21 (table item dealing with the Federal Circuit Court, column 1)

Omit “of the”.

2  Subsection 25(2) (table heading)

Repeal the heading, substitute:

Table 3C—Superannuation salary for the purposes of CSS, PSS, DFRDB and MSBS for specified Part 3 office holders

3  Subsection 38(5)

Repeal the subsection, substitute:

(5)  If the member was a member of the AAT on 1 August 2018, the minimum annual payment to the member, for the year ending on 31 December 2018, is 5 times the amount of the daily fee in Table 4A that applies to the member.

(6)  Subsection (5) is subject to certification by the President of the AAT that work for the member was not available.
