Remuneration and Allowances for Holders of Public Office including Judicial and Related Offices

  1. Pursuant to subsections 7(3), 7(4) and 7(4B) of the Remuneration Tribunal Act 1973, the Remuneration Tribunal has inquired into the remuneration and allowances to be paid to holders of public office, and other matters significantly related thereto, and determines as set out below.

(ii)        This Determination takes effect on and from the day following the day it is registered in the Federal Register of Legislative Instruments unless otherwise specified.

PART 1 – FULL-TIME OFFICES

1.1       In this part, Determination Number 12 of 2012 is referred to as the Principal Determination.

1.2 Table 2A of Part 2 of the Principal Determination is amended by replacing the current entry for the “Chief Executive Officer, National Water Commission” with

the following entry:

1.3Clause 1.2 takes effect on and from 1 July 2012.

1.4       Table 2A of Part 2 of the Principal Determination is amended by replacing the number “2” in Column 6 of the entry for “Director, Australian Institute of Criminology” with “1”.

1.5       Clause 1.4 takes effect on and from 28 March 2012.

1.6       Table 2A of Part 2 of the Principal Determination is amended by deleting “2.2.2” from Column 5 of the entry for “President, Australian Human Rights Commission”.

1.7       Part 2 of the Principal Determination is amended by deleting Clause 2.2.2.

1.8       Part 5 of the Principal Determination is amended by deleting the current wording of Clause 5.1.1.

1.9       Table 2A of Part 2 of the Principal Determination is amended by deleting the word “Manager” in Column 1 of the entry for “Chief Executive Officer, Aboriginal Hostels Limited (AHL)”.

1.10Table 2A of Part 2 of the Principal Determination is amended by inserting the following entry after the entry for “Director-General, National Archives of Australia”:

1.15Clauses 1.13 and 1.14 have effect on and from 6 August 2012 and cease on          5 February 2013.

1.16     Table 3A of Part 3 of the Principal Determination is amended by deleting the entry for “Mr D O’Brien”.

1.17     Table 3B of Part 3 of the Principal Determination is amended by deleting the entry for “Mr D O’Brien”.

1.18     Table 2A of Part 2 of the Principal Determination is amended by replacing the current entry for the “Commonwealth Financial Officer for Norfolk Island” with the following entry and placing it after the entry for “Senior Classifier, Classification Board”:

1.19     Clause 1.18 takes effect on and from 1 July 2012.

1.20Part 2 of the Principal Determination is amended by deleting the current wording in Clause 2.2.21 and replacing it with the following: “Commonwealth Financial Officer for Norfolk Island: The Commonwealth Financial Officer will receive $124,311 pa base salary and $145,120 pa Total Remuneration on and from 29 March 2012 to cease on 30 June 2012.”

1.21Part 4 of the Principal Determination is amended by inserting Clause 4.1.4 after Clause 4.1.3. as follows: “Commonwealth Financial Officer for Norfolk Island: For the period of her appointment, Ms Alison Savary and any immediate family members normally resident with her on Norfolk Island shall be entitled to one return economy class fare each between Norfolk Island and Canberra.”

1.22     Part 5 of the Principal Determination is amended by inserting Clause 5.1.1 as follows: “Commonwealth Financial Officer for Norfolk Island: For the period of her appointment, Ms Alison Savary is entitled to three days recreation leave per annum, additional to any entitlements in Clause 5.1.”

1.23Table 2A of Part 2 of the Principal Determination is amended by replacing “$249,290” from Column 2 of the entry for “Chairperson, Commonwealth Grants Commission” with “$227,240”.

PART 2 – PART-TIME OFFICES

2.1In this part, Determination Number 13 of 2012 is referred to as the Principal Determination.

2.2       Table A1A of Schedule A of the Principal Determination is amended by deleting “A13” from Column 4 of the entry for “Foreign Investment Review Board”.

2.3       Table A1A of Schedule A of the Principal Determination is amended by deleting the entry for the “Australian Reinsurance Pool Corporation”.

2.4Table A1A of Schedule A of the Principal Determination is amended by deleting the entry for the “ARC College of Experts”.

2.5       Table A1A of Schedule A of the Principal Determination is amended by deleting the duplicated entry for the “Independent Hospital Pricing Authority (IHPA),” listed after the entry for the “Australian Electoral Commission”.

2.6Table A1A of Schedule A of the Principal Determination is amended by inserting “2” in Column 5 of the entry for “Independent Hospital Pricing Authority (IHPA)”.

2.7       Table A1A of Schedule A of the Principal Determination is amended by replacing the current entry for “National Offshore Petroleum Safety Authority Board” with the following entry:

2.8       Table A1A of Schedule A of the Principal Determination is amended by inserting the following entry after the entry for “Board of Taxation”:

2.9       The Principal Determination is amended by inserting Clause A47 after Clause A46 of the Additional Clauses to Table A1A as follows:”A47. Clean Energy Finance Corporation Board (CEFC) Members: Until 30 June 2013, in addition to the annual fee, a daily fee of $850 is payable for 7½ aggregated hours of work; only where a member is involved in organisational establishment tasks over and above those reasonably expected of Board Members. Payment is subject to approval by the Chair. Member’s remuneration is capped at $60,000 during the 2012/13 financial year.”

2.10     Clauses 2.8 and 2.9 take effect on and from 1 July 2012.

2.11Part 2 of the Principal Determination is amended by inserting the following sentence after the last sentence in Clause A3: “In lieu of the preceding amounts, the Hon Michael Knight AO will receive $5,238 per annum for service on Australian Hearing Services, Audit and Risk Committee.”

2.12Table A2A of Schedule A of the Principal Determination is amended by inserting the following entry after the entry for “Woomera Prohibited Area Advisory Board (WPAAB) – Independent Chair”:

2.13     Clause 2.12 takes effect on and from 20 August 2012.

PART 3 – JUDICIAL AND RELATED OFFICES

3.1In this part, Determination Number 9 of 2012 is referred to as the Principal Determination.

3.2Table 3 of the Principal Determination is amended by replacing “181,720” and “209,700” in Columns 3 and 4 of the entry for “Military Justice System – Registrar of Military Justice” with “187,180” and “216,000” respectively.

3.3       Clause 3.2 takes effect on and from 1 July 2012.

3.4       The Principal Determination is amended by the addition of subclause 5.8.2 after subclause 5.8.1.  The added subclause will be:

5.8.2 Registrar of Military Justice:  In lieu of the amounts previously determined in Determination 2009/17 (in which the office was identified as the Registrar of the Australian Military Court), Determination 2010/12 and Determination 2011/19, the Registrar of Military Justice will be paid the following amounts: from 1 October 2009 to 31 July 2010 base salary $169,470 and total remuneration $195,570; from 1 August 2010 to 30 June 2011 base salary $176,420 and total remuneration $203,590; from 1 July 2011 to 30 June 2012 base salary $181,720 and total remuneration $209,700.”
