Determination 2009/23:
Remuneration and Allowances for Holders of Public Office, Members of Parliament – Entitlements and Judicial and Related Offices
(i) Pursuant to subsections 7(1), 7(3) and 7(4) of the Remuneration Tribunal Act 1973, the Remuneration Tribunal has inquired into the remuneration and allowances to be paid to holders of public office, and other matters significantly related thereto, and determines as set out below.
(ii) This Determination takes effect on and from the day following the day it is registered in the Federal Register of Legislative Instruments unless otherwise specified.
PART 1 – PART-TIME OFFICES
1.1 In this part, Determination Number 14 of 2009 (as amended) is referred to as the Principal Determination.
1.2Table A1A of Schedule A of the Principal Determination is amended by inserting the following entry after the entry for Australian Organ and Tissue Donation and Transplantation Authority Advisory Council.

1.3The Principal Determination is amended by deleting the current wording in clause C1 of the Additional Clauses to Table C1A of Schedule C and replacing it with the following: “C1. Australian Fisheries Management Authority Commission: A member who is appointed as a Deputy Chair will receive $29,720 per annum”.
1.4Table A1A of Schedule A of the Principal Determination is amended by deleting the entry for the “Administrative Review Council” and replacing it with the following entry:

1.5Table A1A of Schedule A of the Principal Determination is amended by deleting the entry for the “NHMRC – Special Expert Committee on Transmissible Spongiform Encephalopathies”.
1.6 Schedule B of the Principal Determination is amended by deleting the entries for the following committees from clause B1.1 Professional Committees; “Adverse Drug Reactions Advisory Committee”, “Australian Drug Evaluation Committee”, “Complementary Medicines Evaluation Committee”, “Medical Devices Evaluation Committee” and “Medicines Evaluation Committee”.
1.7 Schedule B of the Principal Determination is amended by inserting the following committees under clause B.1.1 Professional Committees; “Advisory Committee on Medical Devices” “Advisory Committee on Prescription Medicines”, Advisory Committee on Non-Prescription Medicines”, “Advisory Committee on the Safety of Medicines”.
1.8 Clause 1.7 has effect on and from 1 January 2010.
1.9 Schedule B of the Principal Determination is amended by inserting the following committee above “Advisory Committee on Medical Devices”: “Advisory Committee on Complementary Medicines”.
1.10 Clause 1.9 has effect on and from 25 January 2010.
1.11 Table C1A of Schedule C of the Principal Determination is amended by deleting the entry for “Land and Water Australia”.
1.12 Clause 1.11 has effect on and from 31 December 2009.
1.13 Table A1A of Schedule A of the Principal Determination is amended by inserting the following entries after the entry for “Defence Industry Study Course”.

2.1 In this part, Determination Number 18 of 2009 (as amended) is referred to as the Principal Determination.
2.2Part 1 of the Principal Determination is amended by deleting clause 1.5.
2.3 Table 2A of Part 2 of the Principal Determination is amended by inserting the following entry after the entry for “Chief Executive, Murray-Darling Basin Authority”:

PART 3 – MEMBERS OF PARLIAMENT - ENTITLEMENTS
3.1 In this part, Determination Number 18 of 2006 (as amended) is referred to as the Principal Determination.
3.2The Principal Determination is amended by deleting the current wording of Clause 2.20, including its subclauses, and replacing it with the following:
2.20Travel by a senator’s or member’s spouse or nominee in order to attend an official government, parliamentary or vice-regal function as an invitee shall be at Commonwealth expense. This provision is additional to any entitlement in clause 2.9.
PART 4 – JUDICIAL AND RELATED OFFICES
4.1 In this part, Determination Number 17 of 2009 (as amended) is referred to as the Principal Determination.
4.2 Part 2 of the Principal Determination is amended by inserting Clause 2.5.5 after Clause 2.5.4. as follows:
“2.5.5 Australian Competition Tribunal: Clause 2.5.2 does not apply to Members of the Australian Competition Tribunal who are paid by way of daily fees. Such Members are entitled to payment for the period for which they undertake official business of the Tribunal on non-sitting days on the following basis:
(i) where an office holder is engaged on “business of the authority”, a full daily fee is paid where the member is engaged for at least 5 hours. A Member is not paid any higher fee for more than 5 hours and any extra time cannot be carried over;
(ii) where an office holder is engaged on “business of the authority” for less than 5 hours on a day, subject to (i) above that period may be aggregated with other periods of less than 5 hours on other days. For each multiple of 5 aggregated hours a daily fee is payable”.
