Determination 2009/01:

Remuneration and Allowances for Holders of Public Office and Members of Parliament - Entitlements

(i)        Pursuant to subsections 7(1), 7(3) and 7(4) of the Remuneration Tribunal Act 1973, the Remuneration Tribunal has inquired into the remuneration and allowances to be paid to holders of public office, and other matters significantly related thereto, and determines as set out below.

(ii)        This Determination takes effect on and from the day following the day it is registered in the Federal Register of Legislative Instruments unless otherwise specified.

PART 1 – PART-TIME OFFICES

1.1       In this part, Determination Number 7 of 2008 (as amended) is referred to as the Principal Determination.

1.2       Table A1A of the Principal Determination is amended by inserting the following entry after the entry for “National Offshore Petroleum Safety Authority Board”:

1.3The Principal Determination is amended by including Clause A42 after Clause A41 in the Additional Clauses to Table A1A as follows: “A42. Australian Organ and Tissue Donation and Transplantation Authority Advisory Council: For the period 1 January 2009 to 31 December 2009, the Chair will receive the Chair’s fee plus an additional loading of 50%.”

1.4       Clauses 1.2 to 1.3 have effect on and from 1 January 2009.

PART 2 – FULL-TIME OFFICES

2.1       In this part, Determination Number 8 of 2008 (as amended) is referred to as the Principal Determination.

2.2Table 2A of Part 2 of the Principal Determination is amended by inserting “2.2.10” in Column 5 of the entry for “Member, ASIC”.

2.3       Part 2 of the Principal Determination is amended by inserting Clause 2.2.10 after Clause 2.2.9 as follows:2.2.10  ASIC: Dr Peter Boxall AO will receive $365,670 base salary and $457,080 Total Remuneration while he occupies the office shown in Column 1, commencing on 2 February 2009.”

2.4Table 2A of Part 2 of the Principal Determination is amended by inserting the following entry after the entry for the “CEO, Australian Pesticides and Veterinary Medicine Authority”:

2.5Clause 2.4 has effect on and from 1 January 2009.

2.6Part 2 of the Principal Determination is amended by inserting Clause 2.2.11 after Clause 2.2.10 as follows:2.2.11  CEO, Donation and Transplantation Authority:Ms Karen Murphy will receive a personal loading of $60,000 to be added to the determined Total Remuneration figure while she occupies the office shown in Column 1, commencing on 1 January 2009.”

PART 3 – MEMBERS OF PARLIAMENT

3.1In this part, Determination Number 18 of 2006 (as amended) is referred to as the Principal Determination.

3.2Subclause 10.4(a) of the Principal Determination is amended by replacing the words ‘fifty cents’ at the end of the subclause with the words ‘fifty-five cents’.

3.3Clause 3.2 has effect on and from 15 September 2008.  The recalculation of allowance from 15 September 2008 necessitated by clause 3.2 is to be based on the number of enrolled voters in each member’s electorate as at the last working day of March 2008.

3.4The Principal Determination is amended by deleting the current wording of Clause 10.10 and replacing it with the following:

10.10 In respect of a year in which a general election is held, immediately following the general election a re-elected senator or re-elected member may call-forward, to cover expenditure incurred after the election, a portion of his or her Communications Allowance from the next financial year’s entitlement up to an amount equivalent to 25 per cent of the current year’s entitlement as provided by clause 10.4.
