Determination 2006/19:

Remuneration and Allowances for Holders of Public Office and Members of Parliament

(i)        Pursuant to subsections 7(1), 7(3) and 7(4) of the Remuneration Tribunal Act 1973, the Remuneration Tribunal has inquired into the remuneration and allowances to be paid to holders of public office, and other matters significantly related thereto, and determines as set out below.

(ii)        This Determination takes effect on and from the day following the day it is registered in the Federal Register of Legislative Instruments unless otherwise specified.

PART 1 – JUDICIAL AND RELATED OFFICES

1.1In this part, Determination Number 10 of 2006 is referred to as the Principal Determination.

1.2Table 2 of the Principal Determination is amended by replacing the current entries in relation to the Administrative Appeals Tribunal with the following:

1.3Table 3 of the Principal Determination is amended by omitting “$174,030” and substituting “$180,570” in Column 3 against “Federal Magistrates Court – Chief Executive Officer”.

1.4Clauses 1.2 and 1.3 have effect on and from 1 July 2006.

PART 2 – FULL-TIME OFFICES

2.1In this part, Determination Number 13 of 2006 (as amended) is referred to as the Principal Determination.

2.2       Table 2A of Part 2 of the Principal Determination is amended by including the following entry immediately under the entry for Examiner, Australian Crime Commission:

2.3       Table 2A of Part 2 of the Principal Determination is amended by omitting the current entries for “Director, Classification Board” and “Deputy Director, Classification Board”, and substituting the following entries:

2.4       Part 2 of the Principal Determination is amended by inserting the following clause after Clause 2.2.4:

2.2.5  Classification Board: Mr Des Clark will continue to receive $173,930 Base Salary and $245,000 Total Remuneration while he occupies the office of Director.  In addition, Mr Paul Hunt will continue to receive $142,630 Base Salary and $206,490 Total Remuneration while he occupies the office of Deputy Director.”

2.5       Part 3 of the Principal Determination is amended by inserting the following clause after Clause 3.1.4:

3.1.5  Non-commercial accommodation: Where an office holder listed in Column 1 of Table 3A elects to be accommodated in private, non-commercial accommodation, such as the home of a family member or friend, a rate of one third of the accommodation allowance in Column 3 of Table 3A is payable in lieu of the amount specified in Column 3.”

PART 3 – MEMBERS OF PARLIAMENT

3.1       In this part, Determination Number 14 of 2006 is referred to as the Principal Determination.

3.2       Clause 2.1(e) of the Principal Determination is amended by deleting the current clause and inserting the following in its place:

“A claim for travelling allowance for an overnight stay or overnight stays under a provision of this determination, or a request for an extension to submit a claim, must be submitted within 60 days from the date the travel is completed. Upon receipt of a written request from a senator or member, the Special Minister of State, or his or her nominee, may approve an extension of time to submit a claim. Where a claim is submitted after the 60 day period has elapsed, and where the Special Minister of State, or his or her nominee, has not approved an extension of time, payment of a claim will not be made;”

3.3       Clause 2.13 of the Principal Determination is amended by deleting the table under the heading Table 2A - MAXIMUM NUMBER OF OVERNIGHT STAYS PER YEAR and inserting the following in its place:
