An Act to amend the Remuneration Tribunal Act 1995
The Legislative Assembly for the Australian Capital Territory enacts as follows:
Name of Act
This Act is the Remuneration Tribunal Amendment Act 2024.
Commencement
This Act commences on the day after its notification day.
NoteThe naming and commencement provisions automatically commence on the notification day (see Legislation Act, s 75 (1)).
Legislation amended
This Act amends the Remuneration Tribunal Act 1995.
New section 9A
insert
9AMembers of Legislative Assembly acting in offices
(1)This section applies if—
(a)the tribunal has determined an additional amount of remuneration payable to a member of the Legislative Assembly in relation to holding 1 of the following offices:
(i)Chief Minister;
(ii)Minister;
(iii)Speaker;
(iv)an office mentioned in section 9 (3); and
(b)another member of the Legislative Assembly acts in the office for a continuous period of 60 days or more.
(2)The additional amount of remuneration is payable to the other member of the Legislative Assembly for the whole of the period the member acts in the office.
(3)However, if the other member of the Legislative Assembly would, apart from this subsection, be entitled to be paid 2 or more amounts of additional remuneration, the member is entitled to be paid only the higher or highest amount of additional remuneration.
(4)For this section, a member of the Legislative Assembly acts in an office if the member exercises the functions of the office in accordance with—
(a)any territory law or law of the Commonwealth that applies to the office; and
(b)the instrument by which the member was appointed, engaged, authorised or requested to exercise the functions of the office.
