An Act to amend the Remuneration Tribunal Act 1995

The Legislative Assembly for the Australian Capital Territory enacts as follows:

  1. Name of Act

    This Act is the Remuneration Tribunal Amendment Act 2006.

  2. Commencement

    This Act commences on the day after its notification day.

    NoteThe naming and commencement provisions automatically commence on the notification day (see Legislation Act, s 75 (1)).

  3. Legislation amended

    This Act amends the Remuneration Tribunal Act 1995.

  4. Section 11

  5. Determinations subject to law etc

    (1)In making a determination under section 9 or section 10, the tribunal must not determine that an allowance is to be paid, or that an entitlement is to be granted, to the holder of an office or appointment if an allowance or entitlement of that kind is to be paid or granted to the holder under a territory law or a law of the Commonwealth.

    (2)A determination under section 9 or section 10 has effect in relation to the holder of an office, position or appointment subject to—

    (a)any territory law or law of the Commonwealth; and

    (b)the instrument by which the holder was appointed, engaged, authorised or requested to exercise the functions of the office or appointment.

    (3)Subsection (2) applies in relation to the holder of an office, position or appointment if the person’s appointment to the office, position or appointment happened on or after 1 July 2006.

    (4)In subsection (3):

    appointment, to an office or position, includes—

    (a)engagement, and reengagement, for the office or position; and

    (b)authorisation or request to exercise the functions of the office or position.

    NoteAppoint includes reappoint (see Legislation Act, dict, pt 1).

    (5)Subsection (3) is a law to which the Legislation Act, section 88 (Repeal does not end effect of transitional laws etc) applies.

    (6)Subsections (3), (4), (5) and this subsection expire 1 year after the day they commence.
