[ASSENTED TO 21ST APRIL, 1908.] B E it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis- lative Council and Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows : - Short title. 1. This Act may be cited as " The Religious InstruJJ- tion in State Schools Referendum Act of 1908." Interpretation 2. In this Act, unless the context otherwise indicates, the following terms have the meanings set against them respectively, that is to say,- "The State Electoral Acts "-The laws in force for the time being relating to the election of members of the Parliament of Queensland; " Elector"-An elector registered under the State Electoral Acts, and no other person; "General Election"-An election held in all the Electoral Divisions of Queensland for the return of members of the House of Representa- tives of the Parliament of the Commonwealth; "Referendum Poll "-The poll of referendum votes provided for by this Act. And if there is no contested election in any Electoral Division the referendum poll shall nevertheless be taken in all respects as if that contingency had not arisen. 4. GREETING: We do command you that a poll shall be taken on the day of ,19 , at the several polling-places duly appointed for the said District, in order to ascertain the decision of the electors upon the question referred to them by and in accordance with "The Religious Instruction in State Schools Referendum Act of 1908," and that you do endorse hereon, as the result of the said poll, the number respectively of affirmative and negative votes duly recorded in the ballot. papers used at the poll, and the date of the poll, and do return this our writ so endorsed to the Governor of our State of Queensland, at Brisbane, not later than the day of . Every power, duty, and liability conferred or imposed by the State Electoral Acts upon, and every direction given to, any returning officer, presiding officer, poll clerk, or other person, for the purposes of the holding and ascertaining the result of elections,. shall (except as may ot.herwise be directed by this Act, or any regulation made thereunder) be deemed to be in like manner conferred and imposed upon and given to the same person for the like purposes in connection with and incidental to the referendum poll. (3.) Every act or omission which woulU be punishable by law, if the same had occ~ rred in connection with the holding of an election under the State Electoral Acts~ shall be held to constitute the like offe.nce, cognis-' able in the like manner, and punishable by the like punishment if the same occurs in connection with the referendum poll. Ballot.papers. 8. The ballot-paper for the referendum poll shall be Schedule. in the form in the Schedule to this Act. The ballot-papers shall be of a colour other than that used in the ballot-papers for the general election. Vote of 9. Publication of result. 10. The Home Secretary shall, within one week from the return of all writs relating to the referendum poll~ cause to be published in the Gazette a return showing the gross number of votes respectively recorded at the poll in favour of and in opposition to the question. Regulations. 11. The Governor in Council may make regulations for carrying this Act into full effect, and for directing," assisting, and safeguarding the taking of the referendum poll; and such regulations shall, on being published in the, Gazette, have the same effect as if they were enacted in' this Act, and shall not be questioned in any proceedings whatsoever. Expenses. 12. All expenses incurred in the execution of this Act and in the taking of the referendum poll shall be defrayed out of the Consolidated Revenue of Queensland, which is hereby appropriated for the purpose.
