Reinier Hendrik Krol (Aka Raymond Murray) v The Queen

Case

[2012] HCASL 27

REINIER HENDRIK KROL (AKA RAYMOND MURRAY)
v
THE QUEEN
[2012] HCASL 27
S354/2011

  1. The applicant pleaded guilty in the District Court of New South Wales to 14 offences involving opening accounts in false names, passport offences, offences of dishonesty and a bail offence.  Other similar offences were taken into consideration.  The sentencing judge (Sorby DCJ) set a number of non-parole periods in such a way that the applicant would become eligible for parole on 7 July 2013.

  2. The applicant sought leave to appeal to the Court of Criminal Appeal of New South Wales.  That Court identified various errors in the sentencing judge's approach.  It regarded the sentences as lenient, but it re-sentenced the applicant on the basis that the total sentence and the individual sentences should not exceed those imposed by the sentencing judge.  It imposed various fixed term sentences on him, and made a recognisance release order creating the possibility of release on 6 May 2013.

  3. The applicant applies for special leave to appeal to this Court.  The papers he has filed concentrate more on the applicant's complaints against the sentencing judge than on the Court of Criminal Appeal's approach.  They also say that the overall sentence of each court below (seven years, one month and 10 days) is "manifestly disproportionate".  They say that the correct total aggregate sentence would be 30 months.  They descend to a level of intense factual detail.  But they do not demonstrate any error of principle on the part of the Court of Criminal Appeal which might result in this Court allowing the appeal with a view to a reduction in the sentences.

  4. The application is dismissed.

  5. Pursuant to r 41.10.5 we direct the Registrar to draw up, sign and seal an order dismissing the application.
