REGISTRATION OF INTERESTS IN GOODS ACT 1986—
REGULATION
(Relating to fees and other charges)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Registration of Interests in Goods Act 1986, has been pleased to make the Regulation set forth hereunder.

Commencement
1. This Regulation commences on 1 September 1991.
Amendments
2. The Registration of Interests in Goods Regulation 1986 is amended:
(a) by omitting from clause 4 (b) (i) the matter “facilities—$5.50” and by inserting instead the matter “or computer on-line batch process facilities—$6.50”; (b) by omitting from clause 4 (b) (ii) the matter “$9” and by inserting instead the matter “$10.50”; (c) by omitting from clause 6 (1) the matter “$2.50” and by inserting instead the matter “$3”; (d) by omitting clause 9 (1) and by inserting instead the following subclause: (1) For the purposes of section 8 (6) of the Act, the prescribed fee for a certificate under section 8 (1) of the Act is:

(a) in the case of an application made by an account customer who requests that the certificate take the form of a statement of account: (i) $2.75 for each item if the application is made by using computer on-line batch process facilities; or
(ii) $3 for each item if the application is made by using
computer on-line interactive process facilities; or
(iii) $3.25 for each item if the application is made by
telephone; or
(b) in the case of an application made by an account customer who requests an individual certificate for a single item— $6 (plus $1 for a facsimile copy of the certificate, if
requested by the customer); or
(c) in any other case—$7.
(e)
by omitting from clause 9 (2) the matter “$25.00” and by inserting instead the matter “$30”;
(f)
by omitting from clause 9 (3) the matter “$100” and by inserting instead the matter “$120”;
(g) by omitting clause 9 (4);
(h) by omitting Part 4 and by inserting instead the following Part:
PART 4—ADMINISTRATIVE SERVICE FEES
Account customer applications
10. The application fee for approval to become an account
customer is $15.
Computer software
10A. (1) The charge for the purchase, by an account customer,
of an on-line computer software package to access the Register is:
(a) in the case of the motor dealer software package:
(i) $150 for the initial package; and
(ii) $100 for any update of that package; or
(b) in the case of the financier software package—$495.
(2) The charges for the installation of an on-line computer
software package are:
(a) $50 for each site visit; and
(b)
an additional $75 for each hour for the installation, up to a maximum of $150.

Registrable interests inquiries
10B. (1) The fees payable by a financier account customer for a listing of all interests registered in that customer’s name are:
(a) an administrative fee of $14 for each order; and
(b) an additional fee, for each list supplied, of:(i) if the list is written—30 cents for each page of the
list; or
(ii) if the list is on magnetic tape—1 cent for each
interest included in the list.
(2) The fee payable by a financier account customer for a
search of the Register, using creditors’ reference numbers only, is:
(a) in the case of a search made by using computer on-line batch process facilities—$2.75 for each interest; or
(b)
in the case of a search made by using computer on-line interactive process facilities—$3 for each interest; or
(c)
in the case of a search made as a result of a telephone inqulry—$3.25 per interest.
Transfer of registrable interests
10C. The fees payable for the transfer of all interests registered
in the name of one financier account customer into the name of
another are:
(a) an administrative fee of $14 for each order; and
(b) an additional fee of $3 for each interest transferred.
Training programs
10D. The charge for providing a financier account customer training program in relation to the operation of the Register is $100.
EXPLANATORY NOTE
The object of this Regulation is to amend the Registration of Interests in Goods
Regulation 1986 so as:
to vary existing fees to allow the Register of Interests in Goods established under the Registration of Interests in Goods Act 1986 to be operated on a commercial “user pays” basis; and
| to provide for new fees and charges related to: |
(i) applications by dealers and financiers to become account customers; and
(ii) the sale of computer software packages to account customers to permit them to access the Register through an on-line computer facility; and
(iii) the installation of computer software packages; and
(iv) the listing of all interests registered in the name of a financier account customer; and
(v) the search of the Register by a financier account customer using creditors’ reference numbers only; and
(vi) the transfer of registered interests from one financier account customer’s name to another’s; and
(vii) the conduct of training programs for financier account customers on the operation of the Register and associated matters; and
(c) to abolish the reduced fee for a second certificate; and
(d) to omit an obsolete reference to prescribed officers.
