An Act to provide for the Registration of Deaths on THE REGISTRATION War Service, and to Amend "The Registration OF DEATHS ON WAR SERVICE ACT of Births Deaths and Marriages Act of OF 1942. 1855," in certain particulars. [ASSENTED TO 19TH NOVEMBER, 1942.] B E it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis- lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- Short title. 1. (1.) This Act may be cited as " The Registration of Deaths on War Service Act of 1942." Construction (2.) This Act shall be read as one with *" The of Act. "Engaged on war service" means serving during any war in which His Majesty is or was engaged- (a) As a member of any Naval, Military, or Air Forces of the Commonwealth of Australia or of any other part of His Majesty's dominions; or (b) With any nursing service, voluntary aid detachment, red cross society, ambulance association, or any similar body or organisa- tion attached to or accompanying any of those forces; or * 19 V. (c) As a representative, attached to or accompany- ing any such force, of any organisation which is providing philanthropic, welfare, or medical services for members of that force, and includes undergoing detention as a prisoner of war or internment in a country under the sovereignty or in the occupation of the enemy, or internment in a neutral country immediately after so serving. (3.) The Registrar-General shall, in respect of every death registered by him under the authority of this Act, make a memorandum in the register to the effect that such death was registered pursuant to this Act. 3. Where, at any time before the date of the Evidence of publication in the Oommonwealth of Australia Gazette of ~ ~ t~ ~ ce. regulation twenty-five of the National Security (Supple- mentary) Regulations (made pursuant to the *National Security Act 1939-1940 of the Commonwealth), the Registrar-General has registered the death of a person who has died whilst engaged on war service, such registration of death shall be deemed to have been not authorised by this Act unless before registering such death the Registrar-General- (i.) Was supplied with a certificate given by some officer who the Registrar-General was satisfied was the officer in charge of the proper records of any Naval, Military, or Air Force of the Commonwealth or any other part of His Majesty's dominions; or (ii.) Had carefully informed himself by a search which the Registrar-General made or caused to be made of such proper records, that the said person had died whilst engaged on war service. 4. Registrar-General, the Registrar-General may, and it is hereby declared always could, register the death of the person named in such certificate. Cancellation 5. The Registrar-General shall cancel any registra- orefgistration tion of death registered by him under the authority of of death on this Act if- war service. (i.) In the case of such registration pursuant to the presentation to the Registrar-General of a certificate of death on war service issued under regulation twenty-five of the herein- before mentioned NationalSecurity(Supplementary) Regulations, it comes to the knowledge of the Registrar-General that such certificate has been duly cancelled; and (ii.) In any other case, it comes to the knowledge of the Registrar-General that the person whose death he has so registered is not dead, and shall, as far as may be possible, recall every certified copy of entry of record of such death issued by him.
