MARRIAGES ACT 1973 - REGULATION
(Relating to fees)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Registration of Births, Deaths and Marriages Act 1973, has been pleased to make the Regulation set forth hereunder.

Commencement
1. This Regulation commences on 1 January 1991.
Amendment
2. The Registration of Births, Deaths and Marriages Regulations 1973 are amended by omitting the Schedule and by inserting instead the following Schedule:

| 1. | (a) | For furnishing a certified copy of or extract from a recording in a register kept under the Act of a certificate of result of search, including the fee for search under any one name in respect of a period not exceeding 5 years ....................................................... | 17.00 |
| (b) | For furnishing a certified copy of a recording in a pre-1905 register kept under the Act where the applicant has provided the relevant number of the recording .......................................................................... 13.00 |
2. For furnishing a certified extract from a recording in the register of adoptions (where the extract contains particulars additional to the name and date and place of birth of the child), including the fee for search under any one name in respect of a period not exceeding 5 years .................................................................................. 17.00
3. For search against any one name in:
(a) the index of legitimations; or
(b) the index to the register of adoptions; or
(c)
the register of births and the register of parentage information in respect of a period not exceeding 5 years pursuant to an application under section 48A (1) of the Act,
including the fee for a certificate of result of any such
search .................................................................................. 17.004. For continuation of search under any one name in respect of each period of 10 years, or part thereof ............... 13.00
5. For giving priority to a search or to the issue of a certified copy, certified extract or certificate of result of search - in addition to any other fee ................................... 12.00
6. For insertion of name or additional name in a recording pursuant to section 34 (1) (a) or 34 (1) (b) (i) of the Act 22.00

7. For insertion of change of name in a recording pursuant to section 34 (1) (b) (ii) of the Act...................................... 32.00
8. For recording in a register of births, subsequently to registration of the birth, the name of, and other particulars relating to, a person as parent of an exnuptial child pursuant to section 42A or 42B of the Act (unless the Principal Registrar, at the Principal Registrar’s discretion, having considered the circumstance in any particular case or class of cases, sees fit to waive payment of any fee or to assess a lesser fee) ...................................................................................... 17.00
9. For furnishing a certified copy of any record or document kept in the Registry of Births, Deaths and Marriages for which no fee is otherwise provided:

10. For each special service in relation to the Registry of Births, Deaths and Marriages for which no fee is otherwise provided - such fee as may be approved by the Principal Registrar having regard to the work involved in providing the service:

EXPLANATORY NOTE
The object of this Regulation is to amend the Registration of Births, Deaths and Marriages Regulations 1973 to increase the fees recoverable by the Principal Registrar and local registrars in the administration of the Act.
